as many of you know yash and I had fought hard for a 2nd interview and finally granted one in which we both could go to. so i went last week with my yash and wouldnt you know it the embassy who sent us the notice of second interview has NO RECORD of granting such a interview, I had to insist and show proof they indeed had granted it and a letter from senators office before they finally said they would see what they could do. 3 hours later.. we are called up to window after watching 3 couples get denied.. and we talked to the korean CO. he also said he wasnt aware of any interview, until i forced him to look at the letters, then he denied he had our file of evidence.. I pointed to it as it was under his hand ( I saw some of our chat logs sticking out) so he asked one question which Yash answered correctly and he started saying he saw no reason to approve.. I was OUTRAGED... but I remaind calm and he and I went at it .. we had brought a absolute TON of every proof known to man.. , he refused to accept.. even though I told him the emails told us to bring all evidence to interview and NOT submit before.. he rolled his eyes and said it was too much evidence to look at just then, and again I respectfully insisted.. he finally gave us the 221g form and said to submit Yash passport and additional proof.. it was crazy and I faxed and called my senator office and told them everything.. they said they will see what they can do.. now its been a week and still we wait.....anyone have experience with 221g and how long did it take to hear anything?

Met 10/2009Married 9/13/2012 in indiaFiled I-130 12/4/2012Assigned MSC case # 12/6/20122/14/2013 called uscis and on 1/30/2013 case moved from MSC to Chicago local office.4/17/2013 letter from senator durbin's office that a inquiry will be made on my case and to allow 30-60 days6/7/2013 NOA2 !!!!! while I am visiting my baby!!!!7/12/2013 letter from senator and copy of USCIS email to them stated our case heading to NVC 7/23/2013 NVC # assigned!!!!!!7/25/2013 called for Invoice identification number and had them add yash's email( Yash sent DS3032 via email nex day)7/29/2013 rec'd email from NVC with DS3032 and AOS invoice, paid today $88 mailed hardcopy of DS 30328/1/2013 AOS pkg mail via fed ex8/6/2013 AOS rec'd @NVC8/12/2013 DS3032 accepted IV invoiced8/15/2013 IV fed ex'd9/9/13 dreaded checklist asking for DS260 b/c DS230 obsolete<p>9/11/13 electronic submission of DS260 accepted
9/17/2013 called NVC case was completed as of today

10/1/2013 rec'd interview letter and date!!!!!!!!!!!!!!!!

11/4/2013 INTERVIEW

RESULT....APPROVED!!!

11/12/2013 email to pick up visa!!!

09/09/15-12/2016 ROC +interview= appproved in over a year

12/21/2016 fedex'd N-400 application and per fedex was rec'd

Timeline

Sounds like Ecuador: Evidence is brought but not accepted or looked at, and it's "Not enough evidence! Go away!" Then, when evidence is brought and accepted, it's "Too much evidence! Go away!" You need to raise cain with your Senator. DON'T give up.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

he finally gave us the 221g form and said to submit Yash passport and additional proof.. it was crazy and I faxed and called my senator office and told them everything.. they said they will see what they can do.. now its been a week and still we wait.....anyone have experience with 221g and how long did it take to hear anything?

I think it's good that they want you to submit Yash's passport. Did he have Yash sign the oath form while he was there?

I can't believe that they have the guts to lie right to your face...the whole time the file is right under his hand. I wish more people from Delhi and India in general posted at VJ so we could get the true story of the stuff that goes on there.

I keep reading that India and especially New Delhi are high fraud, but high fraud for what? I've never met nor heard of an Indian/whatever couple that was fraudulent. Maybe the fraud is in people trying to work here when their real intent is to immigrate. I just don't understand how the reputation of high fraud developed and how that seems to apply to K1 applicants that results in so many denials or hard times given.

I can't believe that they have the guts to lie right to your face...the whole time the file is right under his hand. I wish more people from Delhi and India in general posted at VJ so we could get the true story of the stuff that goes on there.

yes he had yash take the oath.. I wonder if thats any kind of indication? I wish people would also post .. because what I saw there is crazy.. I swear if I had not been there I would not believe everything that happened.. its crazy.. I mean there were like 3-4 interracial couples there interviews lasted 2 minutes.. and u i dont know all their situations but we heard loads of stories on our way out... I just looked at the tracking for his passport and its under process.. I wonder how many months it will say this.. anyhow.. let me know and keep me posted on you and dipu's AP monkey business.. 7 weeks!!? INSANE

I don’t know, I went thru Mumbai consulate and had no problem at all.

Interview lasted like 5-7 mins basic stuff take the oath, sign and some basic question who all was there for wedding, do you have pics, few other things.

That was it, but every case is diverse in its way and I am not sure why Delhi consulate has been giving them so hard time.

This is just my observation I could be wrong, they are more strict on K1 case compared to CR1.

Hi Sherry,

I'm very sorry about the treatment you received at the consulate :(

What was on your 221g slip? From your post it doesn't seem like they placed Yash on AP. What list of evidence did they want you to submit? If you haven't submitted it already, I would suggest that you submit anything involving your future wedding plans, i.e. guest list, name of officiant marrying you and the location of the place you will be married, etc....

I agree though, the fact that they took Yash's passport is a very good sign.

Be patient and soon this hellish nightmare will all be in your past.

It seems like the days of marriage fraud are in the past. I've read several articles of people fraudulently starting up base businesses in the U.S. so they can fake documentation and use it to allow waves and waves of people to come here on the H1-b visa.

How about all the people who come on B-2 visas and never leave???

They should be cracking down on these visas that still have multiple loopholes than treating us like we are criminals for wanting to be with the ones we love.
