What happens if you refuse to grant them entry unless they provide a warrant?

The same thing that would happen if you didn't attend, or pled the 5th amendment during the interview. You may be in the right, but they will make their determination on the information you allow them to collect.

Hopefully, it was a good thing that the IOs came out and they were able to determine that you and your husband are living together. Some leasing agents are lazy and they will just hand write and add an additional leaser rather than typing up a new lease. Once the IOs confirm that that is what the manager did, you should be good to go.

I wish you all the best and hope that your husband will get his approval in less than 3 months.

They wouldn't come in. They don't have a warrant and probably won't get one, because it's of no loss to them if you don't let them in. You don't let them in, that arouses more suspicion than the extreme amount already on you to even get a home visit, and they deny your application, most likely. So you're well within your right, but unless you're hiding something, you're pretty much shooting yourself in the foot.

There was a guy who filed for AOS from K-1 the same month as me (well, it was for his wife and daughter), who had a home visit. They were approved a little less than a month after the home visit, so hopefully it will be around the same for you. Their case wasn't as long and drawn out as yours though, so who knows. :wacko:

I think a home visit means that USCIS has a strong suspicious on such case, to the point they had to make a home visit because sometimes they just want to make sure the couple are indeed staying together for love and not to get the GC and bail out. They will approve you as some point but be prepared for anything because they got you under their giant microscope for now. I wish to you best luck :thumbs:

Thanks! I feel like it was a good thing for the IOs to come since we have nothing to hide. Also it makes us happy that at least they are working on our file instead of it collecting dust in their offices! I seriously had no idea the lease would bring an issue! My husband moved in with me before the lease for that year expired & we went to leasing office & he did the whole application to be added to the lease. I am even surprised that USCIS would question us about it. I would think their job would be to investigate for themselves by at least calling the leasing office! I just hope that's all there was. Praying for the best! Today its one year since our interview :-(

Am praying it will be the same if not faster! The waiting has been too long that waiting another couple of months for an approval wouldn't really make a difference but i just hope they do it soonest so we can be done with this part for now :-) Will keep you informed if i get it soonest!

I just wish we knew what that suspicion was because my husband & i are so transparent with nothing to hide. We have been prepared all along as our lawyer had suggested they might maybe call us for a second interview. I am sure they will approve me, i just wonder after how long :-(

Yes, i felt like it went really well, (except for the part where i forgot to change from my tiny sleep wear:-) Haha, married to you!!!lol....Am praying & hoping for the best soonest. I think we've waited for too long.

I'm sure it was more than just the lease. Lots of people don't have a spouse on the lease (like us) and don't get a home visit.

I think your case and mine are very much the same. I met my husband when I was a F1 student. We got married when I graduated and found a job with my OPT. Our local office was St. Louis too. Luckily a very nice lady interviewed us in 2009 and she granted approval rite away. So don't feel hopeless.

I think your case and mine are very much the same. I met my husband when I was a F1 student. We got married when I graduated and found a job with my OPT. Our local office was St. Louis too. Luckily a very nice lady interviewed us in 2009 and she granted approval rite away. So don't feel hopeless.

I have heard mixed reviews from St. Louis Office. The lady that interviewed us was really nice too & actually had told us we were approved. I wonder if maybe they randomly pick cases for supervisory review, who knows. We have waited long enough though. I hope the approval comes soonest :-)

We don't know what it is, i just said the lease because the IO mentioned it & asked a lot of questions about it. I don't think USCIS would have the funds to do home visits for everybody, that would take a lot, both manpower & money.

Is there a disgruntled former partner or an unhappy friend or family member who doesn't agree with your marriage in either of your pasts who could have filed a complaint about you with USCIS saying the relationship wasn't valid? That can also trigger a red flag - especially if USCIS is not correctly informed on the true nature of the past or existing relationship between the informant and the person being informed upon.

They obviously found the two of you living in the same apartment even if your husband was at work - and you knew exactly where he was and gave them the information that they could easily follow up on and find out if it wasn't true, so it sounds like you probably provided them with sufficient evidence that will lead to a recommendation that the green card be approved.

Thanks! Now that you mention that, i have a cousin who has always been extremely jealous of me!!!!I am not kidding you when i say how jealous she is its unbelievable!I know for sure in my heart she would do anything to make my life a living HELL!!! Oh my God, i really never thought about it!!! She is here in the US too but we don't talk as much. She knew about my interview, even the date from her mother (my aunt). After the interview, the IO seemed to be satisfied & had said i would receive the GC. I wonder if she did call after the interview???And if she called, what could she tell them since my husband & i are married for real? Could someone call & just make up something? And if so, does that mean USCIS has to investigate no matter if there was evidence or not??? I really wonder. Mmmmhhhhh....Sad thing is that there is no way to find out. She also seems to be happy that i have never gotten my green card. Its pretty sad because she is my first cousin too.

Anyway, i hope am approved soon. The officers for the home visit seemed satisfied with everything so hopefully they wrote a SUPER good report :-)
