CR1 or K1 fiance visa ???

Hi,

I'm a new member and need your help!

My boyfriend and I are together for 5.5 years. He is an American citizen living in Florida, I am French and still live in France. I have a 10 years old daughter.

We want to get married, and most of all, we want to live together in America as soon as possible.

We plan on beeing together by August 2012 in order for my daughter to begin school in Florida then.

Here is my question: what is the "fastest" visa to get: K1 fiance (and then, get married after), or the CR1 (we would then get married before)?

Note : my boyfriend will be free (divorcing process ending) in November 2011, and we plan on getting married right after.

Is that a problem, or does it slows things, if we apply just right after his divorce is done?

Would it be easier to apply for a K1 or CR1?

Two other questions: since he lives in Florida, which center should we apply to?

Does anybody know if the American Ambassy in France is supposed to be a "fast" or "slow" regarding visa approuval?

it is not the consulate that is slow, it is uscis...

likely k-1 is fastest.. so don't begetting married until the visa is issued and you are in the usa

simply read the petition directions, the address to submit the package is listed there

It's arguable whether the K-1 route is faster than the CR-1 route. Every case is different, so it is hard to pin down which would be faster.

Here is a chart comparing the K-1 route to the CR-1 route; http://www.visajourney.com/content/compare

The CR-1 route results in an immigration visa. As soon as you are admitted to the US, you automatically will get a green card and be authorized to work.

The K-1 route results in a non-immigration visa. You will not get a green card (legal permanent residency) and will not be authorized to work when you enter the US. You would need to get marry, file and pay to adjust your status to a legal permanent resident. You can not work until you get an EAD (Employment Authorization Document).

We were in similar situation and decided CR-1. IMO it is much harder for them to deny, costs less, approximately the same amount of time to wiat, maybe a little less for K1. But with CR1 he will have a permanent resident card as soon as he arrives and not have to wait a few months till he can work etc..
