Hi, I am seeking advice and information. I arrived in the US Dec of 2008 on a fiance visa. I am in the process now of getting my 10 year permanent resident card I 751 it's under initial review.

I am pregnant with twins and am having a hard time working(physically) . I am going to stop probably sooner than I wanted to. I talked to my boss and he suggested I apply for disability since I have been paying in. My question is am I eligible ? I searched the web site and don't see why I wouldn't be unless due to my immigration / residence status. My husband and I seem to recall when filling out all of the k-9 forms that I would not be eligible for any government assistance ?

The previous posters are correct. You have a payroll deduction line like CASDI or California short term disability that you pay into per paycheck. I think if your company is big enough they have to offer you Family leave which secures your job for up to 12 weeks (I think on the length). This income isn't taxable by the feds or the state so it doesn't count against you for income tax purposes. Have a happy last bit and take care of yourself!!

This is correct, google Family Medical Leave Act. This leave is good for 12 weeks. I think the company has to have over 50 employees??? Anyways with some research you can find all that you need. I have used the Family Medical leave act twice in the last 10 years, but am not an expert.

I'm in New Jersey and have a 10 years greencard. I'm in my 6 months of pregnancy now and also planning to apply for short term disability and maternity leave in next couple months. I'm still working but I also already start having a hard time working. Since the hotel where I'm working right now is under renovation and in transmission I didn't had a problem asking my manager to cut my hours from 40hrs to 25 hrs a week. Then my co-workers adviced me to apply for partial unemployment temporarily since I'm working less hours now and stop the claim of my partial unemployment when I filed for disabilty and maternity leave. I didn't know I'll be qualified for the claim but did tried, and I got it. I guess because they deducting it from my paycheck for 2 and half years and eligible for it even I'm only a greencard holder. So it maybe the same when we apply for our short term disability due to pregnancy.

Since you have been paying for disability insurance, there’s no reason why you should not be eligible to benefit from it. If you need further help, I would suggest you ask your boss or your HR. While you are asking, you might want to learn about other benefits that your workplace may offer, such as life insurance, health insurance, etc. You should know the benefits you are entitled to.
