Hello to all of you,

Once again I'm here to ask a question. My son was born here in the Philippines, but he already got his CRBA and passport. Now my fiance wants to know if he can claim him on his tax return even if our son is living with me outside US or my son needs to be there before he can claim him. Hopefully there are someone who can give us good advice. Thanks and more power to all of the member of VJ. God Bless us all.

nop he cant get a tax return if the child is out of the country its in the law...

ok thanks but how about putting him as beneficiary on his 401k? is there a law for that ?

Ok Vic Vic os totally wrong .

He can Claim the child however it will go under Other as the taxes are Prep .

By a Local Office of the IRS I went to the IRS office and got the answer By them .

The child can be claim by the USC as Longer Nobody else claim the child However must be enter on the Other dependent Category . This statement is word by word from IRS officer

The Kid was Recorded on the Embassy as US citizen birth at Broad and have his US passaport and SS#

Are you sure about that? The child is a US citizen and according to US tax law, a child does not have to live with you to claim him in taxes. As long as the parent is providing more than 50% of the child's living expense, he/she can claim the child in taxes. I have not seen any restriction of child's place of living. They can always confirm with a tax professional.

Again if nobody can can claim the baby that have a SS# he can claim the child that will help him also wend is time for Interview at embassy even if some may say other info. I remember the consul mention me taking care of my boy in colombia and put him on my taxes. as instructed by the IRS

The key is to have a SSN, if your child does not have a SSN you cannot claim them on your taxes in the US.

YES.. he can provide that your son has SS number. if not, you can write "being applied for" (and make sure you will have it for the following year tax returns. good luck

The OP can claim his US citizen child on his tax return. There are four requirements to claim a child as a dependent; 1) particular family relationship, 2) reside with parent claiming child as dependent for more than half a year, 3) age requirement, and 4) claiming parent must provide more than half of the child's support. NO WHERE DOES IT SAY THAT A CHILD OUTSIDE THE US CAN NOT BE CLAIMED AS A DEPENDENT - IT'S IRRELEVANT WHETHER THE CHILD IS INSIDE OR OUTSIDE THE US. http://taxes.about.com/od/dependents/a/Dependents_2.htm

To claim a child on a tax return, the child must have a social security number (or TIN). The only exception is a child who was born and died in the same year. The reason a SSN is necessary is that prior to the change, too many people were claiming non-existant kids without SSN and their pets. Now, IRS requires a SSN (or TIN) to claim a child on a tax return.

oh ok, thanks, I am going to apply my son's ss# this coming 30th. My fiance just wanna know cause he wants to put him as beneficiary on his 401k. Thanks for the helpful info guys.
