single mom of 3 and unemployed but need sponsor

Hi there, was just wondering about something regarding the sponsor thing for a k-1 visa. I am a single mom with 3 kids. Two of them still need day care after school because one of

them is in 2nd grade and the other is in kindergarten.

I have been looking for work but since I can't afford the almost 700.00 a month on daycare costs, finding a job is almost impossible and I have no one or family that can help me because they all work full time.

My attorney said that if I can't find a sponsor then not to worry cause they can have someone at the consulate sign. She told me this shouldn't be a problem. But I have read so much

here on VJ and it has been so helpful, I wanted your guy's advice.

Your lawyer told you someone at the Consulate will sponsor YOUR immigrant s/o? No way.

Not sure how to take your " no way."

Do you mean that my attorney is full of it? I told them that I really had no one to sponsor and she told me not

to worry about this.

Can you clarify your comment please? Thanks. I'm now worried.

No one will sign anything for you at the consul, if you need a co-sponsor you have to find a co-sponsor or there will be no approval no visa etc.

Sorry your lawyer is not speaking the truth.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

No one will sign anything for you at the consul, if you need a co-sponsor you have to find a co-sponsor or there will be no approval no visa etc.

There is no way the visa will be approved without a qualified sponsor or co-sponsor.

Maybe you missunderstood your attorney? The I-134 is only submitted at the interview, so maybe she meant you have some time to figure something out. If the attorney indeed meant someone at the embassy will sign for you then yes, the attorney is full of it and you should dump them.

Do you have any income (ssi etc) or assets?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

You absolutely have a problem regarding sufficient income...

Here's how it works in a nutshell. Including your fiance, you'll need to prove income of 125% of the poverty rate for 5 people in your household (you, your 3 kids and your fiance) You can find the cuurent 2011 poverty guidelines posted here: http://aspe.hhs.gov/poverty/11poverty.shtml

So - in your case you'd need 125% of $26,170 annually.

If you don't meet this criteria you will DEFINITELY need a co-sponser who is willing and financially able to sign the affadavit of supoport.

Also - just so you know, your fiance will not be able to work here until you are married and his AOS is approved, so a good time estimate is anywhere from 3-6 months until he can start to earn any income (plus don't forget the $1040 AOS fees).

wow, I hope u didn't pay for that attorney to do ur k-1 (& if u did, bad lawyer alrdy cuz ur timeline shows u had a rfe)? & if he/she is telling you that kinda bs...I would ask for my money back

reality as it is, if u can't find a cosponsor that makes enough to cover 5+ household ($32k/year), chances of the visa getting approved at the interview is very low & no way n a million years would some random person at the consulate come outta the blue & co-sponsor ur fiance

since u haven't gotten ur noa2 yet, u may have sometime on ur hands to finding someone that is willing to cosponsor you when the time comes

& hopefully ur fiance has some skills/degrees/assets & is rdy to start work, cuz ur unemployed & will b adding another mouth to feed

Firing the attorney might not be a bad idea, but even a new one can't produce a co-sponsor or give the petitioner sufficient income to qualify for the K-1.

Doesn't matter if the fiance has skills or degrees. Reality is that her fiance won't be able to even begin to earn an income until AOS is completed and EAD is issued. If they were to marry the day after he arrives odds are his AOS would be 3-6 months out (assuming they could pay the $1040 for AOS application fees).

Thank you for your help. I only get by with child support monthly. But my ex has a good job and his child support more than helps me pay for all expenses. But now that I understand better, I guess I better start looking again for a sponsor.

Thank You for all your help and info. I have emailed my attorney to clarify her previous email to me, in case I did misunderstand her. But here is the email she sent to me. I bet I did mis understand her, but by reading this, I think it is easy to misunderstand......

"Thank you for your income. If Loretta does not meet the minimum income requirement we can always use a co-sponsor at the U.S. Consulate in Canada. We can proceed now to file the petition and after the petition is approved obtain the financial documents from the co-sponsor for the visa interview."

I've read that part several times and it still sounds clearly what I explained in my original post. What does it sound like to you when you read it? So glad I am catching this now, and not at the last minute.

London allows you to self sponsor for the K1.

And then once the assets are intermingled, presumably his, you would be good to go.

This may or may not apply to Canada.

A Co Sponsor would be easier, but will need to be earning a reasonable sum.

Hi Loretta...

What your lawyer was saying is her email is that if your income isn't sufficient, then you'd be able to use the income and/or assets of a co-soposor. I think you confused that statement to infer that you'd be supplied with a co-sponsor. In reality, a close personal friend or relative is needed to provide sufficient income to qualify.

You should know that co-sponsoring can potentially make a friend or relative financially responsible for your fiance if he would at some point apply for and reveive "means tested" government benefits.
