Hi VJ Family!! If during your visit to the USA, your F2A priority date becomes current, can one adjust status or request to attend interview in USA instead of having to return to home country to obtain immigrant visa, ? Thanks for your responses

Yes. If their priority date is current, and there's a visa number immediately available for them, and they have maintained their valid non-immigrant status, then they can apply to adjust status.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

It's unlawful to enter the US on a tourist visa with the intent to immigrate (adjust status). The person who is visiting family who wants to adjust may be asked to prove he/she did not have this intent. If the person can't prove it and USCIS wants to make an issue of it, the AOS could be denied.

My question was based on the thought that what would happen if i or anyone was visiting the USA and visa bulletin makes a big movement, if it was possible to adjust here. There is no way that that visitor could have had a pre-conceived intent if his/her case is complete at NVC and big visa movement took place like what happened last year in the span of three months.
