AOS approved 8/15/2011 where is the GC?

Had the interview 8/15

On 8/19 we received the notice via mail that said to wait 30 days.

The USCIS website had put us in 'card production' mode and said wait 3 weeks.

Well, 30+ days later, no GC. We called USCIS and had them file something to look into it. The website still says 'post decision activity' and not 'card/document production' like it said after the interview.

Got this back from the USCIS

On 8/19/11, we created a Permanent Resident Card for you and mailed it to the address we had on file at that time. You have notified us that you have not received it and the post office has not returned it to us. We must conclude that it has been lost in the mail. Therefore, you will need to file a Form I-90, Application to Replace Permanent Resident Card. You can download this form on our website www.uscis.gov. You can also file this form electronically on our website. Please follow the instructions on the form. In the future, if you change your address please contact customer service at the number provided below.

Holy ####### ... so because we never received the initial card and they consider it lost in the mail, we have to fork over $450 to get it replaced via i-90?

To help anyone out.

I am not filing the i-90 and paying $450 to get a new freakin GC that the USCIS lost.

So what we have done so far is contact both senators and our House representative to have them contact the USCIS for us.

I also called the USPS and got the branch info for whoever handles our mail. We filed a case with them for missing mail

If none of these work out, then we will get the infopass appt and get the i-551 stamp

The wife is trying to get information from USCIS about mailing date and things like that. Let's see what happens

That is not what the USCIS has stated. They told me you have 30 days from when the card was mailed to you to file for a replacement for free, and after those 30 days, it is the $450 filing fee

A correction on how to get to a live agent, the # combination is 1 for English then 2,2,4,2,1

I escalated to a level 2 who told me it was sent out Aug 19 but had no tracking number. The lady was rude and yelling, so I hung up and called another. This person confirmed that as of March 2011, all green card's sent out have a tracking number assigned and since our approved app did not have a tracking number, no GC was sent out. The CSR created an inquiry as to why we did not have a GC created and we should hear back in 5-10 days.

I am still continuing with the congressional help just in case.

Incorrect. Have a re-read of the I-90 instructions, page 2, part 2B. It DOES say it's free but with this caveat:

Note: This reason for filing does not apply if the card was mailed to you at the address you provided and it was never returned as undeliverable to USCIS. To determine if your card was returned to USCIS, call the National Customer Service Center at 1-800-375-5283 or visit www.uscis.gov and check your case status online. If the card was not returned as undeliverable to USCIS, then you must file Form I-90 using reason "A" (My previous card has been lost, stolen, or destroyed).

Which the OP had stated was their situation. Until they further explained the USCIS never sent the card that is....

The funny thing is, an inquiry resulted in an email stating "lost in the mail, file i-90"

The first level-2 phone call, the lady said "there is no tracking number, the system shows mailed Aug 19" but she wouldn't clarify if the green card was produced and gave very vague run-around answers.

Call #2 to a level-2 had confirmation that it was never produced and mailed based on the fact that there was no tracking number. Her specific words were "once we mail it out, the system automatically adds a tracking number"

We have received all correspondences correctly at the new address, except, of course, the most important one

This seems to happen a lot more often than what you would like and a lot of people who didn't know the 'contact the congressman' or 'escalate to level 2' end up paying the extra $450 and redoing the biometrics.

Yes! They do have a tracking number lately since I got status updates such as

"The USPS reported that they picked up mail from USCIS containing your new card on DD/MM/YYYY. You should receive your new card within 7 days. If you do not, or if you move before you get it, please call our customer service"

and also when I recieved GC, status changed to

"The USPS reported that your new document was delivered on MM/DD/YYYY, directly to the address we had on file. If you did not receive your document, or have any questions, please call our customer service"

Therefore, if you haven't recieved any of these status above, It seems your GC most likely NEVER mailed to you. Nor lost in the mail.

So sorry to hear that you've been through difficult situation. Good luck!

Yes! They do have a tracking number lately since I got status updates such as

"The USPS reported that they picked up mail from USCIS containing your new card on DD/MM/YYYY. You should receive your new card within 7 days. If you do not, or if you move before you get it, please call our customer service"

and also when I recieved GC, status changed to

"The USPS reported that your new document was delivered on MM/DD/YYYY, directly to the address we had on file. If you did not receive your document, or have any questions, please call our customer service"

Therefore, if you haven't recieved any of these status above, It seems your GC most likely NEVER mailed to you. Nor lost in the mail.

Aug 15, 2011 - Approved! FINALLY DONE! (for now)

Oct 03, 2011 - Finally got the damn GC, except they put issue date 2007, expiration 2009 instead of issue 2011 expiration 2013. Rather than reissue the damn thing, they sent an i-90 form to complete and request a new one! Why?

As much as I'd like to think that they don't always update the status of our petitions/applications(their equipment is not always reliable, hence the mailing of notices), there's also a possibility that they messed things up. In your situation, it is clearly what happened. You should have gotten your GC by now, instead you're waiting on something that's never been put in production(or at least that's my guess). That's really frustrating. Don't give up, do what it takes to get your card, you deserve it. You don't need to pay more, you've been approved, you did your part.
