Hello all,

4.5 years ago, I filed K1 visa for my "ex-fiance" (We're no longer together). I went through the whole 9 yards like everyone else here: many trips, dam hoi with my family, ....ect. She came to the US in early 2008, and we were about to married when I found out that she only used me as a tool to get to the US. Within that week, I bought her an airplane ticket and sent her back to Vietnam. It was painful, and unbelievable that it happened to me. ( I grew up with her since we were childhood).

Now, present day. I've met someone else in VN this year. And thinking about moving toward with engagement and all that. But from what happened to me in the past, it made me not trusting anyone anymore.....Well, that's another story.

My questions is. If I proceed with this new relationship. Can I file K1 visa again? Do I need to get a lawyer involve in this matter? Someone here in this board been around long enough and see something similar? My "ex-fiance" and I didn't get married. She was on US soil for roughly a week under K1 Visa then went back to VN.

Have a look at the I-129F instructions. There are restrictions on filing more than 2 in 2 years or something like that but your situation sounds fine.

You only need to ask for the waiver if you've had a K1 petition approved within the past two years, or have ever filed two or more petitions.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
