Planning K1 Filing in Advance

Hello everyone,

I am new to this site and was referred by a friend from work who has been through all of this :). I have been reading everything and going over all of the guides. There is a great deal of very good information. It has helped me a lot. I am slightly confused on one thing though, and maybe one of you kind people can help.

I have been going over the guide for the K1 process (Recently engaged) and I have been downloading the documents directly from the U.S dept. of State website to ensure the forms are up to date. When comparing this websites' guide to the horrible "guide" on the dept. of state website I found a section titled "Required Documentation" ( it is about half way down on this page: http://travel.state.gov/visa/immigrants/types/types_2994.html)

They list all the required documentation such as passport-like photos but they also have a few more forms which I am not seeing on the K1 guide:

(ds-156) # wo (2) Nonimmigrant Visa Applications, Form DS-156 (prepared in duplicate). NOTE: K-1/K-2 visa applicants should not fill in Form DS-160, Online Nonimmigrant Visa Application

(ds-156k) # One (1) Nonimmigrant Fiancé(e) Visa Application, Form DS-156K

(ds-230) # One (1) Application For Immigrant Visa and Alien Registration, Form DS-230, Part I (You are not required to complete Part II.)

Are these all provided by the consular once the K1 is given and the interview is set? or do I have to fill all these our in preparation for the interview?

those last few documents are to bring to the interview, so that is after you've received your noa2, and its been sent to the embassy, you, well i'm sorry, the foreign fiance will need to have those documents filled out and brought to the interview :)

all filled out by the foreign fiance once the case has got to the embassy and depending on the embassy they will either be mailed to the embassy or taken to the interview :)

Ahh ok, it is as I expected. Thank you so much for clarifying that for me.

I also plan on flying over to go to the interview with her, there shouldn't be any problem with that is there? I will have to fill out the paperwork for her because she cannot write English well enough to be confident in filling these out.

Last I knew, these are the packet 3 forms:

DS-230-I Part I

DS-156 x2 (Full out online to generate barcode - Add photo to each, do not sign)

DS-156K (Do not sign)

DS-157 (Male only)

Ideally, the forms should arrive in a packet 3 mailing from the embassy. However, our packet 3 got lost in the mail, so we pulled our forms from the DOS website.

whether you can attend the interview or not is embassy specific... some allow it and some dont

If you check out your local embassy site it should tell you what they will send in Packet 3 (after you get your approval from USCIS). Also, realise you have just joined but if you complete your timeline and profile details as to country of embassy etc it helps for VJ members to give you a more precise response as to what applies in your case. Mar 2011 - After 5mths denied for lost docs - Attempts to follow up failed. Mar 18 2012 - I-129F sent - No sign of NOA1 but they have banked the check...Jul 24 - Update - USCIS has located our file
Infopass Apt - they sorted through everything - our 2011 and 2012 file keep getting mixed up - getting us a Case# (still waiting) Dec- Infopass Appt- expecting to get a case # in about a week ..Still no Case number

Mar 2013 Infopass - advised file was in a box somewhere,and it would be quicker for us to refile. Life gets in the way... New petition submitted July 2014 .

Ok I will check into that, thank you. You said to check my local embassy site, is that one in my country or my fiancees country? I will look into filling out my time line as well, I can see how that would be helpful. Thank again. Sorry about all the stupid questions but I just worry I will make a mistake and I like to be extremely cautious.

Whether or not and to what extent the US petitioner is allowed to be at the interview depends on the consulate. At Vancouver in 2009, the USC petitioners were being allowed up to the waiting room with the beneficiary. They may or may not have been allowed up to the interview booths proper - I don't recall.
