FYI, my Canadian got an I-94 on entry (June 2011) because we had obtained a K1 fiance visa first (via I-129F.) I think you meant this is not received for a tourist visa entry, as she entered.

FYI this is the tourist visitor and student section, Not the k-1 forum. I'm answering based on the OPs situation and forum section.

Okay everyone there's no reason for people to get mad... Everyone asks questions and that's what this site is for... If your going to get mad then don't answer.

People are getting mad because you started this topic 24 hours ago. You need time to PROCESS everything. Sit down with the forms. Highlight stuff. Write down your questions then ask in ONE single post. Before posting do a search for topics that would answer your questions. There is no hurry. You've already overstayed. Giving yourself the w/end to read and process the requirements won't kill you.

Fee waivers aren't available for family-based visas. Those are for things like asylees. Your spouse needs to prove he makes 125% of the federal income poverty guidelines for your family size (available on the USCIS website). Money in the bank can be used in place but you'd need to have 3x the amount, I believe (double check on that though, it may be more) - so if your spouse is supposed to make 20K a year to support your family size and only makes 15K, to make up for that 5K difference without a cosponsor you'd need 3x(5K) = 15K in the bank, which I'd guess most people below poverty line are unlikely to have.

Little_My gave you a great suggestion about staying organized. I'm also a Canadian who married an American, but we went the CR-1 route, not AOS.

Some other tips about organization and digestion of forms/instructions, etc in any situation:

- Print out copies of all the forms you'll need, then with a pencil go through and fill them out.

- Wherever you have questions or are unsure about how to fill something out, highlight it.

- Go back through instructions (or even search on this website, for example "1-130 question 12" and you can see how other people have dealt with it - usually this will answer your question).

- If that doesn't suffice, then make a list of all your questions and write them up in ONE post, so like "I need help on the following questions:....) so that you aren't "flooding" your thread, and it gives other people a better picture of where you need help overall.

- Read, reread, and read again all pertinent forms/instructions/guides. Everyone here knows that's the key to doing everything properly.

- After reading, highlight any important information for you and your spouse to remember in the forms/instructions/guides.

- Do all signatures in BLUE ink, unless it specifically says to use black (look out for any little details like that)

Good luck. Another friend of mine who married a USC just sent off their AOS package a couple months ago, and they were just fine.

thanks a lot, that's what I'm doing now one form at a time... Gonna do a check list for every form... And everything... Do I send i-130 i-485 i-765 i-864 and the medical all in the same package or I send them at different times... That's what I'm unclear about at this point in time

Yes send them all in the same package but keep them separated in there if that makes sense. Get those large paper clips and clip each set together. The form such as the medical exam is associated with the i-864 so clip it with that. Do the same with the everything. Another tip is to get your photos taken by someone who knows the requirements, size, background, etc. I'd send in extra pictures just in case :) Regarding the medical exam and the civil surgeon should know this, do NOT open it, it has to be sent in sealed. The doctor will let you know when you should sign before he seals it.

I just have 2 questions:

- On the USCIS site states there is no fee for the I-864 when filing abroad but yes for domestically. Does anyone know what the fee is? I couldn't find much in the site.

- Someone replied here that the fee is waived for I-765 and I-131 when filing I-485. This was not stated on the USCIS site, is this still true? Just want confirmation.

It is in the instructions that the fee is waived for thos two forms when filed with/at the same time as the 485.

Yes it is still no fee for them.

I just found on the site that the fee is $88, but it says I will be invoiced for it once the NVC begins processing. If I'm understanding this right I do not have to send a money order in for this now, correct?

Your package will never go to NVC. Your AOS package will stay in USCIS jurisdiction the whole time. NVC is for visas. That's why everyone has said there is no other I-864 fee.

It's $420 + $1070.
