Hi i live in Evropa, my dad Permanent Resident( now citizen) USA filled petition F2B for my behelf before 5 years, during this 5 years i have asked for B2 visitor visa 4 times, every time i was refused. First time reson for refusal was cuz my dad filled petition F2B for me, the other time when i asked for b2 visitor visa the "tourist agency" who filled Application(cuz my english was so bad) for me DS-156 didnt said that i was in past asked for B2 visitor visa or that i have pending F2B visa, but this is not reson for refusal my visitor visa, the consular office said thet i not have ties in my country, i not have the job,... I'm now engage to US citizen, he filled i-129f Apllication for me, but the problem is my incorectly filled visitor denied visa, does it look like misrepresentation under section 212a(6)©(i), am i elgable for K-1 visa, please someone help me. Thank you

All I know that if you file for several visas or even file for a specific visa several times and are refused, this can raise flags. That is all I know. The more you apply and especially with different types of visas the more desperate you appear to come here.

4-20-11: Left NVC

4-24-11: Received by the consulate in Abu Dhabi

4-27-11:Received both packet 3 & 4 via e-mail from Abu Dhabi

7-25-11:Interview date-Administrative Processing

8-3-11:Administrative Processing ended - APPROVED!!!!!! :D

8-25-11:POE-SFO

9-10-11:Married!!!

9-26-11:Sent AOS Packet

10-6-11:Received NOA1s via text and E-mail

10-9-11:NOA1 hardcopies received, along with biometrics appointment letter

10-25-11:Biometrics Appointment

Nothing about this makes you ineligible for a K-1.

BUT if you have been knocking on that visa door over and over and over and over, AND you have family in the USA who are not citizens and cannot petition you, then you can be absolutely, positively SURE you will be scrutinized VERY heavily and you need to have very strong evidence of your relationship with your fiance

Being eligible does NOT mean you will GET a visa. Each visa is reviewed for the circumstances of that case. The cicumstances of your case would indicate a strong possibility of a person attempting to get around immigration law and you will need to be prepared for that.
