Need Letter from my fiance's ex-bf to allow daughter to go to USA?

We have letter from court showing Phatcharin has sole custody!

So worried about this because I can't let Phatchain leave her daughter here!!!

After Leana was born,Phatcharin's and her ex-boyfriend separated,he was never around for them but now that he is prison he calls and wants to talk his daughter and I understand that(still hard though)

They both don't get along and we are 8 hour drive from where he went to prison last year for 27 years(selling drugs)

We don't think he will write letter because his mother wants her grand daughter to stay in Thailand! I told Phatcharin to tell her and her ex that she will have school to learn english and still know Thai,

My question is will the prison write letter to us stating he will not get out for 27 years!?

It depends on the laws of the country. In cases where the non-immigrating parent has no parental rights then the consulate usually doesn't require a quit claim from the non-immigrating parent. In some countries, it's sufficient for the immigrating parent to have sole physical and legal custody of the child. In many countries, sole custody doesn't terminate the non-custodial parent's parental rights. If the child's father has parental rights then she'll need a quit claim from him or the consulate isn't going to issue a visa for the daughter. A letter from the prison isn't relevant in this regard. The consulate might ask for proof of where the child's father lives, but this would have to do with whether they suspect that the previous relationship has really been terminated and not anything to do with whether the child can get a visa.

There was no quit claim letter required in our case as the Mongolian courts awarded my wife sole custody in her divorce decree. Maybe this should be moved to the regional forums where it is more likely to be seen by someone with Thailand specific knowledge.
