One week from now on September 26, 2011. I will reach my 5 month limit. I received my NOA1 on April 26, 2011. I have still not received an NOA2! I called my Congressman and I have to wait till Monday to hear any news from him about our NOA2.

I am just completely pissed off right now because there's no one to tell me anything on why it's delayed. If I did anything wrong I should received a RFE by now. I have not received anything! I thought I was very detailed in preparing our I-129F. I followed the guides and had a relative (fellow VJer who is in the USA now after K-1 approval) look over our paperwork with me. I double checked, triple checked, I had everything neatly organized and had a table of contents and all that #######. I guess none of that matters... because I read posts on here where people don't even follow the guides and have barely enough evidence get approved in 3-4 months.

Anyway, sorry for ranting... I have not slept well for the entire month of September because of the whole NOA2 mess. My question is...

Has anyone ever go past the 5 months limit for K-1 Visa NOA2 approvals? Did they ever give you a reason for the delay?

There are a lot of ppl who have gone over the 5 month timeframe... im sure it has nothing to do with anything wrong with your files..its just overload of cases to review... don't worry your time will come soon!!! You can always call USCIS and ask about your case to find out where it is if they know..Best of luck!!!!

There are a lot of ppl who have gone over the 5 month timeframe... im sure it has nothing to do with anything wrong with your files..its just overload of cases to review... don't worry your time will come soon!!! You can always call USCIS and ask about your case to find out where it is if they know..Best of luck!!!!

I really hope so, EAbbas. I just feel so worn out during this process. The long wait, no one to give you a proper update, etc. It's like we're left in the dark until our NOA2 comes. I really wish USCIS fixes this problem. I mean I wouldn't mind if my case status stated it was "Being looked at by a human being now." I just want to know what's going on. I called USCIS and the operator told me basically my case status is still in Initial Review and to call back if we don't received anything past the 5 month limit.

I wish it was just an overload of cases to review, but Vermont is already processing May filers and looks like some June filers were already approved as well. Maybe our stack is being reviewed by someone really slow. Who knows... I called my congressman and he left me a message on my answering machine to call him back (don't worry that's how they operate. They don't like leaving personal information on answering machines), but I was at work. I get home past 5pm and his office was already closed and they will be closed all weekend. So I have to wait till Monday to hear what my Congressman has to tell me concerning my NOA2. Just stressed out.

There are MANY who for what ever reason, have to wait more than 5 months for their NOA2. The USCIS site says they try to get them out in 5 months. I don't speculate why some are done so quickly and why some are slow. For now, I am not getting excited that our NOA2 isn't here yet. We filed at the end of May so it's still early although others have been approved already who filed after we did. I'm sure that will change if I have heard nothing after the 6th month. Hang in there and good luck!!! :D

Your Timeline Indicates: You are not Out of Timelines Status. You have no indication of a RFE. Calling your Congressman/Representitive will be useless since your reply is going to be within guildlines.

Feel fornunate you have not recieved a RFE then the whole process can get out of hand and the time periods.

Other members based on posts have said contacting their Congressman/Rep proved helpful and others said they got a RFE afterwords so take your best guess on that.

The basic requirement for USCIS is 5 months 31 days or 6 months. If in that time you do not get your NOA2 (Without a RFE) then you can put in a Service Request to USCIS to pull your File. (No Tier 2 Rep needed)

Take a chill pill and be patient. It will Come.

I was 7 months, but received a RFE after four months

This morning is our day 171. Just waiting everyday and thinking in the next few days we will be approved. I saw one from Texas and they were on day 192 so I am still not worried.

Hi maning, hang in there the best you can. You're dealing with a faceless bureaucracy here. Think of your state's DMV, at least those people issuing driver's licenses have to pretend to be productive while customers are in the waiting area. This is a million times worse. The USCIS has zero accountability. Applications come in, they take your money quickly, then things just sit in boxes until someone can process them (there are detailed descriptions elsewhere on this site). There is no one to hold them to any standard. They have no reason to care, they have no reason to be productive, nor do their managers have reasons to improve their processes (which I suspect is the real productivity killer). They're getting paid well and a great pension regardless of how they work.

But, eventually, you will get your NOA2. I'm expecting that this miserable, lifeblood sucking process will be a distant memory once my fiance lands at my local airport. Find some ways to stay busy and don't let the bastards get you down.

I truly know how you feel and we are only 2 months into the I-130 process. It's hard being separated from your loved one and to not know what's going on with your petition makes it even worse. You will get you NOA2 soon. It will happen when you least expect it.

In the meantime, start preparing the documents needed for the NVC process.
