Greetings to you all!

I respectfully ask for some light on this, I believe answer is somewhere in the forum I just don't have enough time to lurk long enough on this...

I arrived to States on K1 visa, 2 months ago. Next week my wife and me are planning on filing for adjustment of status from K1 to GC.

My wife hasn't filed her tax reports for 2009, we called the IRS regarding this issue and they told us we can file retroactively for that year, however: my wife was unemployed for that entire year(that's why she erroneously assumed she doesn't have to file tax report..), therefore in her affidavit of support she will put 'zero' dollars earned in the year 2009. Year 2010 was financially better for her, but as of January 2011 she has a full time job with excellent prospects and all the necessary letters from her company that state she is in good standing with them...

Will we have any problems because she didn't make any money in 2009? She will file tax return for that year ASAP.

Also, on my DS-3025 form my doctor checked the box that says 'Vaccine history incomplete' and 'Applicant may be eligible for blanket waiver(s) because vaccination(s) not medically appropriate(as indicated above)'. In that indicated above remark my doctor put remark that says I received certain vaccinations in my childhood and that there was no need of administering them again. Can it possibly happen that I get RFE for either of my two concerns and that I might have to do vaccinations in the States? As for the 2009 taxes I'm completely in the dark here...

No idea on the vaccines, taxes should not be a problem. Situations change, what matter is that your wife NOW makes enough money to support you. I would definitely get those back taxes filed, and include the 2011 income taxes and perhaps a letter from her employer stating not only her employment status but also her salary. You shouldn't have a problem.

No idea on the vaccines, taxes should not be a problem. Situations change, what matter is that your wife NOW makes enough money to support you. I would definitely get those back taxes filed, and include the 2011 income taxes and perhaps a letter from her employer stating not only her employment status but also her salary. You shouldn't have a problem.

Thank you for your input! We are filing that report as soon as possible.

Taxes - you need to submit a letter stating why taxes were not required to be filed

Shots - if your shots were COMPLETE then you only need to send the DS-3025. When I say "complete" I mean you had all the shots for your age range NOT all the shots on the list (the form will almost always say "incomplete" unless a person has every single shot on the list which is unlikely). Did the doc tell you if you needed any once you got to the US to finish a series or something?

If she didn't have an income that year, she was not required to file taxes. Simply explain the reason for not filling. Vaccinations. If you don't have a shot due between your k1 med appointment and the day you file, do donot have to worry. The POE sent your sealed envelop from you k1 to USCIS. If you have any shots due before you file, you need to see a CS and get it done and submit the form with your application
