Hey guys,

I'm pretty sure I already know the answer to this, but wanted to double check with you all.

My mother co-sponsored my husband when we filed for his adjustment from K-1. That got approved in Nov. 2009 with no issues. We sent out our ROC stuff on 9/12/11. In the past few days there's been an unfortunate falling out between my mother and I and she wants to revoke her support of my husband. I told her she was unable to do so, it was a legally binding contract that she was stuck with now, yada yada. She just informed me she will be contacting the INS to let them know she is no longer living in the US (she moved to Mexico in April 2010, but retains US citizenship and frequently has visited the US--she's currently here and has been so since May due to some court things she's been going through locally) and needs to be removed as his sponsor.

My understanding is that this won't make a lick of difference, she's still going to be held to what she signed up for regardless, until he reaches his 40 working credits, becomes a citizen or loses his LPR status or if, gods forbid, he passes away before then. Am I correct in this assumption? And will her trying to make a stink now with this have any effect on his ROC? Some of the "proofs" we submitted with that package included not only our bank account together, but him being attached to her bank account as well. I don't know at this time whether or not she will remove him from her bank account, but it is a very likely possibility. My assumption is that it won't matter atm, as we already sent that info in and they don't actually call the bank to confirm that it's all real and still in effect, but of course I'm still a touch worried about the havoc this could potentially cause for us.

I honestly don't think it matters, like you said, it is a legal contract. But if you really have your doubts I suggest you ask a lawyer

11/21/1011 Applied for SSN

11/26/2011 Social Security Card in the mail!

12/22/2016 Mailed N400 forms Dallas Texas

12/30/2016 USCIS received N400 application (Texas Lockbox)

01/31/2017 Biometrics appointment at West Palm Beach ASC

02/03/2017 Notification (online) - Application in interview process

07/25/2017 Text notification that my case was updated. Interview scheduled! Waiting for letter with interview date. 
07/31/2017 Letter received in the mail! Interview date: August 31, 2017. Notice date: July 26, 2017

08/31/2017 Interview - Approved - Oath letter given to me same day

09/07/2017 Oath Ceremony!

your are spot on, there is nothing she can do, until he becomes a USC. no problem, you as the petioner are the main sponsor. as long as everything is well with you, then there will be no problems at all. they want to know that your marriage is still a bona fide one, that it continues to be right.

Yeah, that's pretty much what I was expecting to hear and glad to have someone confirm my own thoughts! Things are fantastic with my family, our marriage is wonderful and I don't expect there to be any issues with that side of things with ROC. Trying to not to let the stress over the family drama get me too worried about this stuff :)
