We filed for my wife's AOS in March and are still waiting for an interview to be scheduled and/or a CSC transfer and approval. The I-864 we filed was, of course, accurate at the time it was filed back in March. In August, the job I had ended (contract position) but I will start a new job this Monday. The salary for the new position is well above the 125% line as was the previous one's, so my question is:

Do I need to file a new I-864 with the new information? I would think not since it was accurate at the time of filing and I'm bound by it regardless of where I'm working. Or, do I just need to put together a new package of offer letter/letter of employment, pay stubs for the new job, etc. in case they ask at interview time? Since I only had about 6 weeks off, should I bring the previous job's pay stubs as well to substantiate what was accurate at the time of filing and well after? I sent them 4-1/2 months of pay stubs with the I-864 and have since collected about 5 more (from the previous contract job). I don't know how many I'll have on hand for the new job since our interview date is still TBD...

In any event, now I'm worried that they'll schedule our interview during the first 60 days on the new job when I'm forbidden to take any time off (under penalty of job termination).. :unsure: And, as much as I wouldn't want to do it after such a long wait, how hard would it be to re-schedule if my choice comes down to AOS vs. job?

My husband had a change of jobs as well during our application process.

What I did was, I filled out a new 864, but I didn't mail it in. I brought it with me to the interview.

I brought paystub, and the letter of employment. I offered these to the IO, but she said there was no need; she only took the pay stub. But you never know... bring all of these, JUST IN CASE.

But I don't think there's any need to mail it in. That might probably prolong the case. So just print out a new form, fill it out, and bring along with you the documents.. And by all means, bring the pay stubs from your previous job as well. It's better to have extra stuff, than no stuff!

As for you rescheduling an interview. I heard that it prolongs the process and makes it a little more complicated. Something about them reviewing steps.

I'm sure if you explain to your new employer, the'll understand. This is a very important date! My husband had to take a "vacation day" a week into his new job... but... they understood.

Just bring the letter along..

Thanks.. That's good to know about the I-864.. I'll have a new one ready just in case as well as the supporting docs for the new job. I'm also thinking of having one from a co-sponsor as well (just to have ready if I'm forced on that day to choose between keeping the job and going to the AOS interview).

I'll explain the situation next week when I start but just from the job interview process, this employer seems very strict and unaccommodating compared to any other place I have worked in the past so I don't know how well it will be received. Truly, the last thing I want to do is delay any AOS interview!

Thanks for all your useful comments. My case is a little different and I need your guys help!

I filled out form I-864 and send it in November. At that time I didn't have enough income so I included my husband's income, who is the intending immigrant, to meet the income requirements but now my income is enough for filing. Later we got a mail from USCIS asking for my husband's last year tax return and also something which shows he is authorized to work in the US. We have last year tax return for him but we don't know about the work authorization!!! Now I have two questions:

1- what is the work authorization for an international student who works on campus 20 hours a week? He can only work on campus as TA or RA!

2- Can I disregard the USCIS request for evidence and fill out a new I-864EZ? If yes, where should I send this new form?

I really appreciate your help
