Timeline

Hi, I know this information is probably in the guides and I looked but I cannot find it. I was hoping someone could tell me where to look. I have a friend that I work with who is from Malaysia. His name is Jeff. He is not a U.S. citizen, but does have a green card. His fiance is in Malaysia and he is going to marry her when she some to the states to see him in November. After she goes home, he wants to petition to bring her here with him.

I am wondering what is the type of visa that he will have to apply for and how long will it take him.

I am wondering what is the type of visa that he will have to apply for and how long will it take him.

F2A - Spouses of Permanent Residents. This is a numerically limited category, the most current visa bulletin shows it's a 3 year wait before a visa becomes available.

He will still file the I-130 petition with USCIS, his wife will apply for the visa when one becomes available.

If he becomes a citizen after filing the petition, he can have it upgraded to spouse of US Citizen.

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Exactly what Ryan said. Depending on how long he has to go before he can become a citizen, it may end up being a shorter wait if he waits to become a citizen before applying and then applies for a CR-1, as once he is a citizen a visa will be immediately available for his wife. That time frame would be 8-10 months wait on the visa, plus however long he waits to become a citizen.

08.25.2010 - NOA hard copies received (x4), case status available online: 765, 131, 130.
10.15.2010 - RFE received: need 2 additional photos for AP.
10.18.2010 - RFE response sent certified mail
10.21.2010 - Service request placed for biometrics
10.25.2010 - RFE received per USCIS
10.26.2010 - Text/email received - AP approved!
10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.
11.04.2010 - Text/Email (2nd) - EAD card sent for production
11.08.2010 - Text/Email (3rd) - EAD approved
11.10.2010 - EAD received
12.11.2010 - Interview letter received - 01.13.11
01.13.2011 - Interview - no decision on the spot
01.24.2011 - Approved! Card production ordered!

REMOVAL OF CONDITIONS

But do I understand correctly that when he becomes a citizen he can upgrade the petition to one from a U.S. citizen. So should he go ahead and get married and then file and if he still does not have his wife here by the time he becomes a citizen then change the petition to one from a U.S. citizen.

That is the best choice. This way his petition could be approved by the time he gets his citizenship.
