GC expires oct,25th and I am going overseas

My conditional green card expires next month on october, 25th and I mailed my I-751 to Vermont earlier today. I know I am going to receive a NOA, supposedly in not too long, that besides being proof that I am legal in this country it is also a work and travel extention.

My question regards travelling...I want to go to Europe to visit my family next month, after I receive the NOA and I don't plan on being back before october,25th. What do I physically need to show at the IO at the POE in order to be re-admitted to the country without problems once I get back (sometimes around november, 15th)? Is there anything I need to go and do at my local office, or I just need to have my expired green card and NOA? I suppose I shouldnt have problems, I read the FAQs and guides, I didn't find anything specifically like my personal situation so I just thought I'd post to be extra sure about what to do and what I need. I haven't dealt with immigration stuff for almost 2 years so I am back to nervous mode... :help::lol:

NATURALIZATION

28th july 2007 - N-400 mailed to VSC

(exactly on the 90th day mark...applications NOT returned although some scared me into thinking they could have!)

30th july 2007 - N-400 delivered to VSC

The NOA, which is a year's extension of your GC will suffice. I'm a bit ####### and will have a copy of my expired GC if they take it away from me at biometrics, but I don't think that is 'officially' needed at POE. I hope you get your NOA in time! Vermont seems to have slowed a little. I submitted on Aug 20 and not a peep yet.

Thank you so much for your reply!

I am going to wait for my departure, I won't leave until I have my NOA, my husband is in the military so we are using free military flights to go overseas therefore I am not going to lose reservations or anything like that.

Edited to add: you haven't received your NOA yet since august, 20???Or you meant the appointment letter for biometrics?

Mine runs out in November so I got in at the earliest cos I too am traveling a lot when it expires.

I could have filed in july, but I have a 6 month old baby, hubby is in the military and we have no family/close friends nearby that could give us a hand, so it took a lot longer than we wanted to put the whole file together...that's why it was mailed only yesterday. It sucks...I haven't seen my family in a very long time and I am looking forward to take the baby over there so that they can finally meet him! Thanks for the fingers crossed, right back at ya! ;) I do hope I will get lucky and that Vermont will start being fast again, so we can both get what we need! :yes:

Would you mind letting me know when you receive your NOA please?

I'm more or less like you, Churipu, I sent my I-751 to Vermont on August 26th, they got it August 28th, and I haven't get the NOA yet. I'm travelling overseas too, so I'm waiting for the NOA to get my ticket. I hope I would have got it by now.

I've also read that they slow right up over August because of staff taking holidays, so we'll see. I think if your card is expired and you try to re-enter, you may encounter problems?? I don't know, if that happens to me, I will just have to get an infopass before traveling to see what is happening.

I don't know what happens if you get caught out with an expired card. That is, I can't say definitively, although I suspect that you would be admitted (maybe scolded, but you ARE still a PR).

Since you are a PR, you may NOT use the VWP or a tourist entry; you must present yourself as a PR to be admitted.

Since this recent slowdown with the NOAs is just starting to affect people, I think it's in your best interests to hang on for a bit longer, tho I realize this hinders your plans somewhat, this is my thinking:

IF (big IF, let's not focus on that ;) ) no NOA shows up and you are in the last week of your card's validity. At THAT time, I'd go to my DO (InfoPass) with proof of mailing my I-751 and its reciept, evidence of the payment, my GC and passport and ask for a stamp. I have no experience to say that this does work, but it does make sense and would be AN option. This at least gives you a fixed date to purchase your tickets (after card expiration).

I have an Infopass appointment at the Baltimore office tomorrow in the afternoon, I will ask all these questons to the IO and then I will post here what they will say.

I have thought of another plan:

what if I go on my trip, and somebody mail me the NOA when it gets here? That way I could reenter legally.

I too wanted to do this. Not having it mailed, but actually have my husband bring it to me once he joins me in november since we both decided we want to spend Xmas overseas at my folks (he is taking me there since we fly military planes but he is coming right back).

I will ask about this too tomorrow.

I have another question. I sent a money order. Is there a way to know if they cashed it? Would the bank give me a receipt saying that they have cashed it?

I sent a money order as well. Mine has a 1-800 # on the back that you can call, an automated system picks up and you can punch in the serial numbers of your MO and it tells you whether it has been cashed or not. I am not sure they are al like this. If not there have to be some sort of customer service you can call. Just check on the receipt you have.

Quick update about my Infopass...we cannot go today :( , hubby had an emergency at work and won't make it by the time we have to be there and he is the one who has the only car we have...On Monday my baby has to see his pediatrician, so I am going to try and schedule an Infopass for tuesday.
