Well there there are really State that wont allow you to use your married name not unless you have changed your name in the DHS or USCIS which is done by applying for AOS. I have the same experience. The SSA in my state didnt allow me to use my married name even if i showed my marriage certificate. Thats why even if im married my SSN is still under my maiden name...Different state have different policy i guess... :whistle: :whistle:

Posted

; let me start from the beginning as of it gives you a better view into the situation :whistle:...

* I came to the US August 12th 2011

* got married in Texas on August 28th

* filed for SSN a couple of days later.

This is what happened when I filed for SSN that day;

I asked this lady that I would like to apply for SSN/Card and she said OK. I told her about K1 and that I got married and that I'd like to have my husbands, thus my new last name on my SSCard. She said it wasn't possible because me changing my name should be approved by USCIS first (she was going through a file with procedures/information about K1's).

I told her that I didn't understand her. I came here on a K1 Fiance(e) Visa and got married 2 weeks after my arrival, so within 90 days and I also brought my valid passport with visa & I-94 inside of it AND my certified Marriage License.

Yet, she told me, a little aggrivated that she couldn't change my name as of, once again, it should be approved by USCIS.:pop:

Ok, same day, I posted a topic here about what I should do. Most of the VJ members told me that I should wait for my SSCard with my maiden name on it, and change it to my husbands name as soon as I received my SScard. Alright.....

I received my SScard a week after I applied, and 2 weeks later, TODAY, I went back to the Social Security Office to change my last name.

This is what happened today, take two :wacko: ;

I came into the office and got called by the same lady who "helped" me the first time I got there. I told her that I'd like to change my last name since I received my SScard with my maiden name. Again, I brought my passport with K1 Visa, I-94, and my certified Marriage License. She asked, weren't you here before a couple of weeks to apply for a SScard? I told her yes and that I received my SScard with my maiden name, but since I got married with my USC husband, I'd like to wear HIS name. :bonk:

She then started to put up this attitude, saying: what did I tell you last time?!!! I can't change your name until you get approval from USCIS. I told her with one eyebrow raised HOW? She then said that I have to change my name on my I-94!!!! I'm like, that is the white paper that I received in my passport as soon as I got through Customs and Border Security in the airport. How am I supposed to get a new I-94? Go out of the country, which I'm not allowed because I haven't received an AP yet or GC. So, since I didn't understand I asked her what she meant. She couldn't give me a straight answer and her attitude got worse:"I don't know how often I need to explain to you that I can't change your name, contact Homeland Security!!!!" :blink:

& then I got all aggrivated saying, you're the one who works here and should know what I need to do in order to get my name changes because I thought my Marriage License was enough to change my name since I am MARRIED! Then she started talking about that I can only get my name changed if I have my EAD or GC and contact Homeland Security. :unsure:

Ok, so this is what happened as of I thought I could change my last name on my SScard since I married my USC husband.

I am just confused because I thought it was easy to change my last name :whistle: .

What's the best thing I should do, wait til I get my EAD or GC? :help:

Channa & AAron --congrats on yr wedding . They are just blowing smoke . I applied for a SSN after 2 weeks of my Fiancee arrival in the Usa . We received the card in her maiden name . After we were married , We went back and had her name changed on the card . We Received the new SS card 1 week later with her new name on it . Sorry you had that experience. I got married to my husband in Nigeria. I read the requirements for name change on SS website. I took my photo id and marriage license. I received my new card exactly 1 week later. I would suggest you print SS policy on name changes, USCIS policy, go back with your required documents, and switch the time of day so you get someone else. When I went it was 20 mins before closing and everyone wants to leave on time! And if that fails ASK FOR A SUPERVISOR, but don't stoop to her level again it will get you nowhere.

Shes lying lol i'm sorry you keep getting this idiot woman.

I got my ssn after marriage, 2 weeks after entry and did NOTHING with USCIS at all, hadn't even filed AOS yet and was granted SSN in married name.

The woman at the counter told me its no problem to do it in married name she just needs the marriage certificate, the process is the same as a USC changing their last name from marriage.

Same here!I got SSN a week after marriage and had no problems to get my married name on the card...

I'm curious: what advantage is there to changing a name on the SS card before AOS is adjudicated?

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . The one absolutely certain way of bringing this nation to ruin, of preventing all possibility of its continuing to be a nation at all, would be to permit it to become a tangle of squabbling nationalities, an intricate knot of German-Americans, Irish-Americans, English-Americans, French-Americans, Scandinavian-Americans or Italian-Americans, each preserving its separate nationality, each at heart feeling more sympathy with Europeans of that nationality, than with the other citizens of the American Republic . . . . There is no such thing as a hyphenated American who is a good American. The only man who is a good American is the man who is an American and nothing else.

Always take a printout from the website showing the rules about an immigrant changing their name. Every time I had to go into a government office I took the guidelines so that if I had any problems I could just lay those down on the counter and point to the highlighted section(Plus, I'd rather make them feel like an idiot than to go to jail for punching someone). It saved me a lot of trouble more than once because of dumb people who don't know what they're doing. SSA was no problem for Mathew, it was the DMV that was our problem.

You really just have to show them what they can and can't do since most of them don't have the sense the good lord gave a goose. If they don't know how to process something they usually just make something up. I was told that by a former customer of mine who works at the SSA office. Shocking!

Good luck. Don't give up if you want your married name on your card. Plenty of people have done it and it IS possible.

There isn't any advantage to changing name on the SScard.

I think it's normal that since I'm MARRIED and decided to have my husband's name, I want it on any kind of identity because this is the name I wear since the very first day we got married and will have for the rest of my life.. why still have my maiden name? I am proud to wear his name :thumbs:

I'm a USC but got married in Texas too. I had my new driver's license (which I know you might not be able to get yet) and had my marriage certificate. The person was very nice and was able to change my name on my SS card to my married name. If you live in an area where there is more than one local office, you might try another office. Might get someone who's more courteous and helpful.

Funny... I went to the office after receiving my EAD with my maiden name (Em B), and I requested my SSN to have my husband's last name (Em Z).

All fine and dandy. She checked my immigration status, and two weeks later my SSC was under the name Em Z.

I posted a topic as well because it might actually be a problem if your immigration documents don't match your SSN.

I went to the DMV to get an ID with the EAD in my maiden name, and the SSC in my married name, and my new ID has my maiden name (EM B) because they said that the true document that establishes your identity is whatever immigration has it as.

NOWWW..... I spoke with my IO and she said that if the SSC had my married name, then the DMV should accept that as a name change. I could change my name on immigration whenever (and if I don't want to pay the fee, I could just wait for naturalization).

Sooo. I find it really odd that they didn't allow you to change your name!

You're "REQUESTING" a SSN in your new name, so i don't see why it should matter.

Have you tried going to a different office?

Most states match the driver's license application info against the SSN record, so the driver's license will need to be in the maiden name. The name the IRS uses to verify the name on the 1040 comes from the SSN record, so taxes will need to be filed with the maiden name. If the EAD comes and she works, the employer is supposed to use the name on the SSN card/record for the W-2.

Get it changed ASAP.

Ann came over on a K-1 visa and we were able to obtain a Social Security Number (SSN) for her immediately. After we were married, we took the marriage certificate back to the local Social Security Administration (SSA) office and requested a card with her married name. They obliged ... we were literally in and out in about fifteen minutes ... and we received a new card in the mail in about a week. If there are other SSA offices reasonably near where you live, you may want to give them a try, because the one with which you are dealing is clearly out to lunch when it comes to dealing with these matters.

Good luck!

Joe
