Hi All

My husband and I just recently got married in Cuba. The official who performed our wedding told me that I would have to come back to the states and legalize our marriage. I have spoken with a lawyer and was told that since we are already legally married in Cuba I would not have to legalize/register our marriage here in the states. The lawyer proceeded to tell me that I would have to apply for the I-130 and then it would be best if I applied for the IR1 / CR1 visa. I was wondering if this info is right? I always assumed that i needed to register and that the K-3 visa would be best to get my husband here sooner.

I traveled to Cuba illegally, without US permit. Wondering if this will affect the I-130 process...

Also on another topic, Cuban's usually have a “first last name” which is the family name and a “second last name” which is usually the mother’s maiden name. On the I-130 form should I use his second last name as a middle name? or should I use the field “other names used” for his second last name?

Any help would be greatly appreciated.

The K-3 visa used to be faster than the IR-1/CR-1, but nowadays the time difference between them is so little that is better to go IR-1/CR-1.

About having 2 last names, in the forms I used both of my wife's last name in the field for last name and everything was fine.

I think thats about right. You will be applying for the CR-1 visa... Oh and for the last names just put it as it is... Last Name: (fathers last name) Maiden Name: (mothers last name before marriage).... its the same as in mexico so yeah do that! Good luck...

Oh and I dont think you have to legalize ur marriage in the US, once ur married anywhere in the world the US will know and respect it! Trust me!

You should use both last names for the last name section of the I-130.

I dont think the process will be affected.

NO, you should not. but you can use both (first & second last name), for example Jose Albert Solis Flower), or you can just drop the 2nd last name.

I130 is your 1st step to bring your family members (spouse, children) to the usa. ir1 is for 10 yrs visa (provided you have married more than 2 yrs), most people has cr1 visa. good luck

The CR1 is the final result of the i130.

The USC files the petition (I-130); the beneficiary applies for the visa (CR-1).

You just fill out the I-130 for immigration, the type of visa will be decided by the National Visa Center (no worries, they know its CR-1)
