Hello everyone.

I was granted asylum in May 2005. I applied and receied my EAD back then but never worried about renewing it and never had any trouble getting employed.

The SSA web page "Types Of Social Security Cards" clearly demonstrates that if your Social Security card shows only your name and SS number; you are have been "lawfully admitted to the United States on a permanent basis."

Being unemployed for over two years, I have received unemployment, food stamps and other benefits, without any problems BUT ...

I recently applied for a job at Papa John's and after being selected, they denied me the job.

Among the documents they requested, they wanted to see my I-94, which is stamped with the "Asylum Approved" seal and my Social Security card which DOES NOT have any employment restriction on it. Both documents were shown to them in ORIGINAL.

The reasons they gave for not accepting me were:

  1. "There is no expiration date on your I-94, that is not normal" and,
  2. "Your Social Security card shows a date on it, that is not normal"

I can only guess they implied my I-94 and SS card are fake!!!

My questions are:


  • Are these people right in denying me employment based on what they said? and,
  • What can I do?

Please advice. Any and all comments on this issue are greatly appreciated.

What annotation exactly is on your SS Card (with the date)?

FWIW, they didn't say your presented fakes they just said that there were things on your documents that are not normal.

Maybe they e-verified you and it shows you have not renewed your EAD and are therefore not able to work. The type of SS card does not mean you are work-authorized. For instance, a LPR gets an unrestricted SS Card, and they could lose their residency (either leave the country for years or fail to remove conditions or other things) and still have that card. It doesn't mean they are authorized to work.

The annotation on the card is the date it was issued.

If an police officer stops you because your tail light is out and he asks for your driver licence, after which he states "this driver licence is not normal", the next thing he'd do is cuff you and throw you in jail. That is because he cannot just imply your the driver licence is fake; he's got the duty to further investigate. he just "implied" it was fake, he might not be able to state it, because he is not a judge nor an expert.

I really wanted to punch this guy in the face, but I've got to go back and might show up with a lawyer.

This is what I was replied at another forum:

Your employment has been denied unfairly. Please print the page 10 of this document "Handbook for Employers" and show it to your employer.

"After being granted asylum in the United States, the asylee will receive a Form I-94/I-94A with a stamp or notation indicating asylee status, such as “asylum granted indefinitely” or the appropriate provision of law (8 CFR 274a.12(a)(5) or INA 208). This document is considered a List C document that demonstrates employment authorization in the United States and does not expire. If the asylee chooses to present this document, he or she also will need to present a List B identity document, such as a State-issued driver’s license or identification card."

You are considered "an alien authorized to work", not "permanent resident".

In your opening post you state the employer requested documents.

Did they specifically ask to see certain documents?

I know this discussion is a little old, but I just want everyone to know that the US Department of Justice has a hotline that you can call where you can speak with a lawyer for free.

I had an experience whilst I was on a J1 visa. The company hired me but when found out I was on a visa did not want to keep me employed (which is illegal). The lawyer I spoke to called and spoke to the company and the problem was sorterd out.

He also said if I had any further problems I could issue a claim against the company.

Know your rights, don't let any employer push you around if you have the legal right to work here!

Received RFE for tax return: 26 Oct

Responded to RFE: 31 Oct

EAD & AP received:2 Nov (Day 49)
