Difference in spelling of last name

Hello:

I am a recent petitioner for the fiancee visa. We discovered a couple of things recently. The spelling of my fiance's last name on her birth certificate differs from her current (non-US) passport name by a couple of letters. The name essentially reads the same in the native language. The application was submitted with the name shown on the passport. Now, I understand that my finacee is required to provide her birth certificate etc? With the difference in the spelling, would it be wiser to file an amended application with the difference in the last name noted? Notify the USICS of the difference? Are there any other procedures one can take to remedy this? If you've experienced something similar, I would appreciate hearing how you handled your situation.

My fiancee's bc is wrong. We are desperately paying big bucks to get it changed right, so it reflects her name on the passport.

Thanks for the replies. So, Aymerlu, the birth certificate name was not an issue at the time of visa issuance??? Thank you, and Congratulations on the visa , the baby and the wedding. What a triple treat!

I was mulling over the possible reason for our second RFE when I got on this thread.

In the OP's case, the beneficiary's name has the problem. And I am guessing your husband is the beneficiary. Now I'm not sure if my concern should be in this thread. Anyways....

In our case, my fiance is the USC, and his name in his passport has a 'Jr.' in it, which shouldnt' be the case. He has used that passport the last 2 times he went to Manila, but we discovered this only afer the I129F was filed late June. We submitted both his BC and passport in the petiiton package. Apparently, our lawyer missed it (and fyi, we're ready to fire that lawyer grrrrr).

Now we have a 2nd RFE and we're expecting this to be the reason.

The alien fiancee of a friend of mine had a 2 week or so delay in the issuance of her K1 visa as a result of something like this. The English transliteration of her surname was different in the final letter between her passport and the translation of her birth certificate. My friend knew about the difference, but had not indicated the alternate spelling in the Other Names Used section of the petition or visa application forms, nor had his fiancee gotten a new translation of the BC to match the passport. The consular officer noted the discrepancy during the visa interview and ordered new security checks for the previously unrevealed alternate name.

If the birth certificate is not in the English language get a new translation to match the passport.

If the birth certificate is in English and your petition is still in processing at the USCIS you can try to notify USCIS of the alternate spelling of your fiancee's name, but your letter may not catch up with the case file. If it's too late for the USCIS, include the alternate spelling on the DS-230 visa application.
