So today after administrative review K-1 visa for my fiance was denied. reason: not enough evidence of the relationship. We're together for 4 years. There was nothing wrong with our case (no criminal records, no past marriages, no past entries or attempts to enter USA). How long does it take for the embassy to send the paperwork back to USCIS and what can I do after that?

What country was it from and what evidence did you provide for your relationship? This is a hurdle you need to figure out so the next time you have what it takes to convince them.

Seems like the country is Armenia. Not sure about that consulate.

You will be better of consulting an immigration lawyer. Is there was anything at the interview like unanswered questions, uncertanty in the answers, did you got form 221G?

Interview was over a month ago, than it went to administrative review (221g was given, he brought all the documents that were required). Today they denied him. We sent all the possible evidence: pictures, plane tickets, passport stamps, e-mails, phone records, skype and IM records, all of that ####### over 4 years of our relationship. And yet, denied.

Seems like you have a legit relationship and you had all the evidence. As I said previously contact an immigration lawyer, you may also want to contact your congressman and get him involved as well.

Sorry that your visa is denied.

it could be they found something during the review...that maybe you didnt even know about....you def need to find out exactly what questions were asked and what answers he provided and id you sent all the proof there is another reason they denied....you should have a heart to heart so that should u decide to refile for him in any capacity this obstacle wont be in the way again...however if its something else that they found out during the review....you also need to find that out.

I'm already sending letters to the embassy and to the NJ senator (yet again). I need to know how long does it take for USCIS to get the papers from the embassy.

in the embassy they said that all the questions should be directed to USCIS after they receive all the papers back from the embassy. Embassy does not answer questions

Sorry that your visa is denied.

I'm sorry but you can't say this. Pictures and all the other evidence the OP mentioned doesn't prove a relationship.

What was the 221g for? Obviously something happened that caused the consulate to deny the visa; senators CAN NOT help in this regard.

The consulate won't deny the visa unless they had big suspicions; all of these must be taken care of before any kind of future visa is attemtped. Four years together seems like enough time to have a real relationship develop....there must be more to this story than you are telling.

Ok then how can you prove LDR otherwise. It makes no sense if it doesn't prove the relationship than what does prove LDR, I am currently in K-1 process, how then I can prove it, if photos, IM logs, phone records are not evidence? And don't forget it is a K-1 Visa.

:bonk:

Though I agree that OP need to provde more information on 221g, and the whole story behind. As you said 4 years is long enough...... but there should be more to this....

I think there is more to this story that you, the petitioner, doesn't know about. Is your fiance telling that this is the only reason why it was denied? My fiancee visa just got approved after 15 days of 221g review and all the evidence that you presented, was way more than what we sent. To me there is a more legitimate reason than just not enough evidence. This could be something related to your fiance, his police records, medical, etc. but he is not telling you exactly. I think is time to have a serious conversation with him. These are just my two cents. I am sorry that you are going through this. Good luck!

There is nothing more. 221g was given because i needed to provide a co sponsor, so we found a good co-sponsor and provided. however, their answer for the denial was that: NOT ENOUGH EVIDENCE WAS PROVIDED TO PROVE THE RELATIONSHIP. That's all they said. nothing more. The rest of the questions they said we have to ask USCIS when the case is received back.
