Iam trying to help a friend who seems lost in his thoughts..

He first came here as a tourist and got accepted into a school and had his visa changed to F-1.

Shortly, he couldnt afford school and he just dropped it all but never left the country. Now for as far as i know his only option would to be marry a US citizen, but what if he gets a job that is willing to sponsor him...

I know that if he leaves it will be hard for him to try to come back with his tourist visa.. but what if the company hires agrees to hire him can he try to go out of the US and come back in the US using the visa that the company is willing to provide? is it possible?! Because he has no visa to change.. he would have to leave the country first right? Have anyone here ever heard of anything like this? Please help! Thank you in advance!

Your friend is out of status and will accumulate days of unlawful presence. Generally, unlawful presence is forgiven when the visa overstay marries a US citizen. It is not forgiven for an employment visa. He will not qualify for an employment visa because his unlawful presence will not be forgiven.

Thanks for the quick reply~

I once spoke to a lawyer, it was a favor so i couldnt get further into the conversation, but basically what he said was that if a person "sneaks" out of the country, lets say thru mexico by car.. he will not be asked to return the I-94...

and he that he could bet on his luck when talking to the immigration officer at the airport when he comes back, alleging that he first came as a tourist(which is true) and then took a road trip thru mexico all the way to south america or something...

at the time the attorney said that it would be a 50/50 % chance the immigration officer lets it go or not...

any knowledge on that??

I think thats the last thing, after that, its going from this website to a dating one~ to find him a wifey lol :)

The lawyer told him to lie. Probably not the best legal advice. Your friend should not listen to a lawyer who tells his client to lie.

The things that are being suggested here seems fishy at best to me and im not part of the immigration dept.... i have a feeling these

ideas wont' go unnoticed by a trained eye...

The lawyer told him to lie. Probably not the best legal advice. Your friend should not listen to a lawyer who tells his client to lie.

I can tell you that it was the crappiest advice you have got from the crappiest lawyer.

If this was an immigration lawyer then he has no freaking clue, even if he sneaks out his school has already reported him as no show and has already reported him to USCIS.

Even if he sneaks out (hopefully) USCIS know he had illegal presence in US.

He has no option to convert to work visa, even if he has a employer sponsoring him and my best guess is he has not told the employer about his illegal presence.

Are you sure you'd want to encourage a friend to seek a spouse for immigration benefits? Aside from the obvious issues in proving the bona fides later, why would you want that for your friend? Some of the more desperate cases here make it abundantly clear that some people do not take marriage seriously.

Don't be hasty in this, OP!

vj is made up of a lot of ppl wanting to go thru the immigration process the right way even if it means going thru more red tape to do so...you wont get anybody to condone the current ideas because they are not right and it is misrepresentation at best.
