applying k1 but will put married?

ok here's the situation my friend got married by proxy but they will apply for k1,and his hubby still going to put in the form married.is it right to put married to apply k1 even just use proxy?or it will going to be trouble in process?

Proxy marriage makes the immigration process very very difficult. They should be prepared for a lot of extra steps.

Yes I know this situation and it's my situation.the one who wrote above is my friend.I asked her about my hubby put that we are married by proxy in the application form applying k1 visa and I keep asking him if it's good idea he said he know what he's doing and just trust him but I think its not but I don't wanna argue with him so my friend tell me just follow him atleast u did my part and I said whatever it takes wrong for us that's his fault not mine.hayy I dnt knw wat to do...

Honestly I kinda believe in him coz when I get my I'd on DEERS he used our marriage license by proxy marriage and now I got my I'd card telling I'm his spouse and still using my lastname .he told me i'll still gonna use my passport to flight going to states and my lastname will change it there if ever my visa approved.the question is do our applying k1 visa is not a trouble for us if we put married like my friend said.coz my hubby says it's not so who am I going to believe?

I don't understand, why ask for trouble? K1 is for a fiance that wants to marry when they get to the US. You don't even want to give them the thought that you might be married. Even though proxy marriages are mostly not recognized as marriages, someone, either at USCIS or the embassy, if it gets there, is going to question this. Certain embassies might deny you outright. If you want to be married, get married for real and file CR1. Good luck!

there was someone else that did the same thing not to long ago on vj

you have put yourself in a catch 22 situation.....your married so your not single k1 will not work for you....but immigration will say your not really married because you have not consummated the marriage and according to their wording with out that its not considered a legal marriage....how ever if you try for k1 it can be denied because you did proxy marriage....i don't say this often but you need an attorney

yeah they been together for long time..they both working in korea and then they do married proxy here in philippines..

They will deny the petition application and KEEP their money. Then they can file the proper visa petition type.

her hubby keep insisting that they will just do k1 since immigration not really favor in proxy married but her hubby keep insisting too that he knows everything and still put married on form...i wish he really know what he doing cuz on what i read its really impossible to do k1 but still put married..besides they didnt registered their paper in nso saying they really married..

If she lies about not being married at the interview she faces a ban for life. Hubby is not doing the smart thing here.

if she puts Married by proxy then she is not eligible for K1 coz K1 is for those who are not married YET. Whatever lies they are planning to put on the immigration form once caught..they will have a big problem in the future.

well i didnt know the whole story until we talk clearly..but anyways thanks for all the advice and hoping her hubby will clear his mind on what he doing..
