If looking for good news on this subject, since the child is over 16, do not require permission for that US passport from the other biological parent. But still have to provide proof that kid is yours and dealing with a different agency.

To each to his own on the subject, my view is that I opened the door with the USCIS to bring my girls here and I wanted to close that door with them, the hell with saving 600 bucks. Both surrendered their USCIS issued green cards, case is closed.

With SS, three visits to them for each girl, EAD, LPR cards, and finally the US citizenship certificate, was only a couple of blocks away from my drive to work. You could have applied for an SS card the instant your kid got his green card. Can skip that stage and wait until he gets his US Passport, SS will accept either the passport or the certificate. Surprised you waited this long to get your sons' SS card. Girls SS number never changed since day one.

Legitimacy has nothing to do with the Child Citizenship Act. Don't confuse one immigration law with another. Legitimacy matters for somethings such as petitioning a parent, but does not matter here.

I wasn't confused. I was reading the section of the USCIS website on citizenship for a Biological or Adopted Child Residing in the US.

Ok here's my experience. I have 2 kids who came here on Immigrant visa with my wife almost 90 days ago. One kid has just turned 16. He is covered under the CCA and I applied for his Certificate of Citizenship and his US passport before his 16th birthday. He has his green card and ssn by the way. I am still waiting on the certificate but the Passport office has asked for more proof of biological relationship since my son's birth certificate was issued recently in his home country. We have been through this process with USCIS before. And it specifically says on the Dep. of State website that you do not need any proof to show if you have been through USCIS and have recently entered with a valid visa. But they are GOD you know, so I would rather submit proof than argue with them. So here I am, just sent in DNA test which they asked for -not mandatory: another 450 bucks plus 600 for the C of Citizenship at their altar.

Like another poster here said- get both and close the door on them FOREVER.

10/04/10 - filed for I-130

2/14/11 - I-130 approved in 148 days

NVC

3/23/11 - NVC case number assigned

3/23/11 - Called NVC and gave email addresses to be added to case

3/26/11 - DS-3032 form received.

3/26/11 - Paid AOS fees online.

3/30/11 - AOS package received by NVC

4/8/11 - DS-230 Package IV fee payment option available, paid same day.

4/12/11 - Package IV fees shows as Paid. Mailed Package IV documents

4/14/11 - Package IV delivered to NVC.

4/26/11 - SIF!!

6/7/2011- Interview date

6/7/2011= Received 221g asking for co-sponsor

7/7/2011-VISA APPROVED

Did the post office ask for the proof or the DOS?

I had to mail in the original green cards of my kids (I adopted them after they adjusted status, came here on K2) and some other stuff, but to the DOS.

I now got a letter from USCIS that they do not need to ROC (after getting the package of my husband returned twice for not submitting the biometric fee of the kids, though I mailed in a copy of their passports, long story!) because citizenship is already granted.

So even without Certificate of Citizenship the door is closed. They know my kids got citizenship! I am still debating whether I should spend the $600 for each child to get the CoC.

The Post office asked for copy of green card, took the passport from country of birth, copy of birth certificate,a signed form, fees, photographs, copy of my driver's license and I forcefully gave her a copy of my US passport and naturalization certificate. All this in anticipation that no other documents would be needed. The proof was asked by Dos and here we are, DNA testing and all. By the way he never got a request for biometrics. They were taken at the Port of entry at the time of arrival.

I will keep you posted if the CoC or passport shows up in mail any day.

Just an update that we received the US passport in mail last week. So the CoC will arrive when it does.

Doesn't he need SSN to apply for US Passport first? I read that there is a fine if you don't write an SSN.

Since no SSN was issued for him prior to his passport application it is OK to apply for the US Passport without it. Maybe you can include a note in your passport application stating that no SSN was issued for him. You can ask the person processing your passport application about this.
