Just thinking...

Kinda insane... that USCIS will ask for children as proof.

Me and my husband have no kids yet because we're quite busy moving in just two years of our marriage. And since we're too far from our in-laws now and my husband is studying, we're delaying to have a kid at least a year until we both get situated and we can manage our time better. It's kinda hard that I am working on shift job and he is studying.

Anyway, crossing my fingers that the evidence we submitted is enough.

How advice is offered is as important as the advice itself. Treat people like idiots, they won't listen to you, and you might as well not waste your time. But if you haven't figured that out by now, you never will.

Likewise, act like an idiot, and you'll be treated like one. How a question is asked will determine how answers are given.

Kinda insane... that USCIS will ask for children as proof.

They do no such thing.

They're saying _if_ you have kids together, that could be considered evidence of a bona fide marriage. But nowhere do they say "must have spawned offspring to be considered legit".

Not yet, the letters are at our home, and all I have is JPEGs that my wife Scanned to me. I don't want to post the images because of all the privacy information that is on them. Once I get back home, I could post the text. In a nutshell, the first letter includes:

- "the evidence submitted with your form is insufficient. USCIS requires certain additional evidence to process your form."

- "All evidence should be submitted at the same time on or before 5 Dec 11."

2nd letter includes:

- "Your supporting evidence does not sufficiently establish that you and your spouse entered the marriage in good faith and the continue to share a life together.:

- "You submitted a copy of your DOD ID card, copy of your 1099 INT showing a joint savings account, copy of a voided check showing joint checking account, and evidence of joint car insurance."

- "Although these items begin to establish the indication of a relationship, they are not strong enough, as a whole, to establish that you and your spouse entered the marriage in good faith and continue to share a life together."

The letter then lists the following as "Good Faith Marriage" examples: Children as a result of your marriage, Evidence of a common residence, Joint financial resources, and health, financial, and estate planning arrangements with each other. I submitted evidence for everything except the Children because we did have any at the time. I wonder if I should submit the medical paperwork that documents our 3 miscarriages? Thats terrible if we have to do that.

The third page includes information about a required response during the designated time period and what the consequences will be if we don't respond in time.

Thats it, in a nutshell.

I hope this was a generic letter. I noticed it said you submitted your DoD ID card; did you not submit hers also? What about her TRICARE card? Is she the beneficiary of your Servicemans Group Life Insurance? If so, go to your servicing personnel office and get a letter to that effect.

They are not denying you, they are asking for a little more proof.

OP - the "big" ones you missed in your evidence submission are joint taxes and joint lease/mortgage. A lot of people have reported sending in the RFE and getting approval within days.

OP - the "big" ones you missed in your evidence submission are joint taxes and joint lease/mortgage. A lot of people have reported sending in the RFE and getting approval within days.

With housing prices today I refuse to saddle my fiance with the burden of my house!

My wife is not on my mortgage either. Mortgage company says to add her name will require refinancing and a new loan. She is the beneficiary of the house however, should I croak. Seems like a good deal for her all around.

There is no one single piece of evidence needed, so if you choose to not add a person to a mortgage, that is fine (though I would think that if one person helps pay that mortgage with their income, they should at least be on the deed or officially on some sort of paperwork, like the above). However, that is still an important piece of evidence, and that missing, along with another "biggie," the missing joint federal taxes, should be the first to be addressed in the RFE.

She will be on a utility bill as soon as possible, that seems to be a biggie here for establishing residence. Taxes will be joint effective 2011. DEERS will be soon after, and I thought that would be the one to set it in stone!

We didn't had any morgage or utility bills with my name on it, and had no problems. Sure, we had a RFE, but I send in the past 2 or 3 years of Tax return/transcripts, and then copies of our joint checking and saving accounts (+copy of baby ultrasound and copies of bills adressed to to each of us, showing the same adress). Got approved in no time after that.
