Used Maiden Name Throughout CR-1 Process

Hey all,

All of my wife's paperwork for CR-1 was completed under her maiden name. Are there any issues with this at the time of interview (which is next week)? We figured after the process is completed and assuming all goes well with the interview she could just get her name changed on her Green Card and Social Security card.

So, just wondering if anyone else went this route.

It's no problem, but the name on the GC will be maiden name, not married name. You can pay to have it changed after you get it, or wait until ROC. There is no requirement to change your name.

Not a problem if she wants to use her maiden name. The only problem you have is since you are doing the CR1 your wife will be issued a GC in the name on the application filed i.e. her maiden name. To change the name on the GC will cost you money as you have to file I-90 and pay $450. You could wait until your wife files for citizenship and then change her name or she could just continue to use her maiden name.

I used my maiden name throughout the process since I hadn't changed my name legally and had no issues whatsoever. I'm just gonna wait till citizenship to change my name legally as it'll be free then.

Thanks for your reply. Yes, the plan was to change it at ROC as I heard it can't be changed until that time anyway. Figured we'd change all the documents at that time.

It's not that she wants to use her maiden name but we didn't want to spend time changing her passport, we wanted to file ASAP as we were behind as it was.

Didn't realize it was a $450 fee, guess we'll change it when she applied for citizenship then. Thanks for the tip!

No issues as long as her passport also has her maiden name. The visa will be issued in the maiden name and the passport must hav ethe same name - I am sure you submitted her passport copy with DS-230.

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

My spouse used her maiden name throught the CR1 process(I 130, G325, DS 230 e.t.c) even though in the marriage certificate it shows her married name. Her passport is still with maiden name.

Thanks all, all of your responses have helped.

Our marriage certificate even shows her maiden name! I guess it's because it is showing her with her maiden name marrying me, at least the way it's worded.
