hi all vj'ers!

me and my fiance are just over 2 months now on getting our NOA1 hardcopy :). i was wondering though, the 129f documents i have heard can be denied. that you can be denied with the whole k-1 process even before the interview. since me and my fiance got our noa1 hardcopy, we were not denied our 129f right?

why would you be denied the 129f?

and if you have your noa1 hardcopy your safe from that denial from that right?

im just curious, i just dont want to be denied something before the interview or anything after waiting months and months for a denial which isnt even the actual interview :\

The denial might come if it comes out that someone is not eligible for a benefit or not eligible to file a petition. For instance, if someone in the couple is still married, it will get denied. If the couple hasn't met in person in the past two years, they will be denied. These items can't be fixed, because these requirements must be met at the time of filing the petition. But, most other omissions can be fixed with an RFE. A NOA1 does not make you free from denial, but an I-129F petition denial is very rare. Good luck.

there could be many reasons why one is denied

the NOA1 is not is not an approval - it simply means that USCIS has recieved your petition and will begin adjudicating

once your I129-F is approved then you will recieve an NOA2

but even with the NOA2 that is no guarantee to recieve the visa

you could still be denied during the interview process

nothing is guaranteed until the visa is in hand and there are still more processes to go through stateside

dont panic

Correction: When your I-129-F is approved, you receive an APPROVAL NOTICE. NOA2 has no official meaning. RFEs are "NOA2s" too.

My Approval notice was my third notice from USCIS as I had an RFE too.
