Flying within US while waiting for AOS approval

My husband has been using his passport as an ID to fly within the states. The visa (1-94) expires 10-3-11. We have some trips planned for October, how can he fly if his visa/ID is expired? Is there another form or something we can use to prove he's ok to be in the states? Any suggestions??

He can fly within the US. He won't go through any immigration checkpoints. TSA checks identity, not status. Good luck.

Be careful, I came across TSA who didn't know what an EAD is. At least keep a copy of the I-485 with you which will prove that your husband is here legally.

Bear in mind though he doesn't need to SHOW proof of status to travel you can still run into ICE officers who want to see proof of status. This would mean the NOA1 from your AOS. Once he is out of status (once his I-94 expires) he IS able to be detained and locked in immigration jail. He won't be deported but that can be an expensive adventure as you will need money to bail him out until he goes before an immigration judge who will tell him to AOS immediately or leave the country.

He IS technically okay to be in the US because there's no deadline for AOS but he IS also out-of-status unless he's filed AOS. Once he's filed AOS he's in a period of authorized stay.

No airline employee and no obese TSA drone checks any citizenship or immigration status of a traveler, nor are they authorized to do so even if they wanted to and the only way to get in contact with CBP is either in the bathroom or by pulling out a loaded gun at the body scanner and scream "I'll take you all with me to Allah, you imperialist pigs"

Yes, I've seen this occasionally. A more likely scenario that can occur at any international airport is the TSA "Travel Document Checker" (yep, that's their real title) will notice something suspicious about a passport and will call CBP over to examine the passport. CBP will take action if they determine that the passenger is out of status.

The trick is to carry all your documents, Get a state drivers license, that is all they will want at TSA. Once you have your I797 you are here at the grace/courtesy of the attorney general. Don't leave the country with out a AP.

Keep a copy of your NOA for AOS just in case. Me and my husband went for our honeymoon in Hawaii and we were veeery surprised to see that neither one of these airports in Philadelphia, Dallas, Los Angeles and Hawaii cared I made the reservations on my new name and I showed as ID my passport with my maiden name. I had my marriage certificate, but they said: Oh, don't worry, it's ok, we don't need to see that. lol I'd still take it.

Thanks for all of your input everyone We already filed for AOS and have our NOA1 for it so we will just bring that with us. (We got a FL Drivers Lisence but they have it to expire the same day as the I-94. so stupid.) Hopefully the next set of paperwork will come soon! Thanks again!
