K-3 Request (I-129F) and Pregnant

Hello all,

Question: My wife and myself were married in Texas (Sept 2010 and have license), as she was there on a work Visa when we met, and decided to come live in Ukraine for a few years. While here we have become pregnant and would very much so like to have the child in the states. We ended up filling the I-130 and 1-129F in Aug and have a due date of Jan 19th 2012. We are looking for information as to the reality of getting the visa (K3) within the time period or any other options. We don't know if we can go on a tourist visa and have child while waiting on the more perm visa, anyone know the answer to this? Any help would be fantastic.

Very very unlikely you'll get the visa in time, especially as she may not be allowed to travel past the 36th week of pregnancy. Also very unlikely she'll get a tourist visa, having a US citizen spouse and pregnant with his baby. Plus how would you pay for her pregnancy and the birth in the USA?

Is there a reason you want the child to be born in the USA? If you are worried about citizenship, the child will be an automatic US citizen even if born in the Ukraine.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Unlikely you'll get the visa in time for her to safely fly to the US.

most airlines won't take a pregnant woman on their flight if they are over a certain number of weeks - you are quickly approaching this.

It is typically a 5 months wait from NOA-1 to NOA2, then another 2 months of waiting through NVC and then the wait for the interview. So with a filing date of August, you're realistically looking at February for a visa issue date at the earliest.

We have decided we wish to move back to the states and wanted to have the child there so that we could get through the move before the birth. As to funds we are OK in that area and would be able to pay for the birth. We are just trying to see if there are any options to try and get back in time.

Not on the basis of pregnancy. If she is high risk with a very unusual case maybe.
