What is there to do now?

Hello All,

On Aug 25 I had my naturalization and that very day I emailed my naturalization certificate with a petition to upgrade the application for my wife from Preference Category F2 to IR1. However the next day (Aug 26) they notified me that application was upgraded to CR1. Since my marriage to my wife was over 2 years, I again sent an email with the copy of my marriage certificate requesting to upgrade status to IR1. They responded back to me via email on 1st Sept that my petition is now under review and it has passed almost two weeks without any result. Calling them is futile since they tell you that it may take up to 20-30 business days. Now I'm thinking I should have been content with the CR1 status and proceeded with the rest instead of trying to correct them. Since the review is not completed, I cannot even send the DS3032. Any one faced similar situation before or can advise on what I can do? I'm feeling very frustrated at this point. I have been calling them almost every day and have also pleaded with them over the phone with no result. I also asked if there are any papers that they need and they just reply that this review takes 20-30 days. I am at a loss! Any help?

The review isn;t necessarily because of your request, it could be normal processing or any number of other issues. I wouldn't worry too much about the CR-1/ IR-1 issue in future though, they will realise at the embassy level how long you've been married.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I would kindda agree with Penguine_IE that you can't really say for certainty why a case went for further review, but in this case, your request could trigger it.

However, I don't think there would be anything hold you from sending DS3032 (choice of agent). This is an email and I haven't seen any specific guideline as to when you can send it. The worst that could happen is it sitting in a mailbox. When you are going to call NVC to update the petitioner and beneficiary's email address, you can also make a inquiry about the DS3032. I know someone correct me earlier saying one should call first before sending DS3032, but the other one worked in my case; hence I don't think there is any hard & fast rule on which one should go first.

My suggestion, just call or send DS3032 and do the other one. That way, you don't need to spend a day after the review is over. My personal experience with NVC was awesome and I met few wonderful people who went beyond their way and give me clarification on my questions.

I hope soon you will hear something positive. Good luck and keep calling :-)

Thanks Guys! Infact I did sent my DS3032 but they replied me saying my app is still under review. Been calling everyday ad they say there will be no result in sending the DS3032 before it has been generated on their system to submit. Everyday same statement: Please allow up to 20 to 30 days for the DS3032 to get generated and once your app status has been reviewed.

I will keep on calling but feeling a bit frustrated with NVC,since I thought if you have the correct docs, this stage passes smoothly without any delay!
