Religion a factor?

Hey all,

I'm currently undergoing the AOS process, my husband and I are both Muslims, he is a Muslim USC which reverted just about a year ago; in my religion we can't marry a man outside of our religion..anyway, we're doing fine and have no problems as he didn't really follow any religion before he met me. There was nothing in the forms asking about faith or religion, will this be something that will come up during the interview and if it does, will it be a problem that he reverted?

Oh and one more question, we have a different way of marriage in our religion which needs to be conducted down the road after we're done with the process; what matters to USCIS is getting married and registered in the U.S, correct?

Married is married. If you aren't legally married now then you can't adjust status based on marriage.

Religion will not come up at any stage of the process. However, bear in mind that beneficiaries from certain countries experience a more thorough level of scrutiny due to the country they come from. I don't know if Jordan is one of them, but I assume so.

What matters is that you get married within 90 day upon entry into the US. So long as the marriage is valid, you're good.

Edit: obviously you need to be free to marry when you arrive, and the marriage has to occur in the US. if you are already married in Jordan before arriving to the US, you are not free to marry.

I am legally married and have a marriage license. Was just wondering if the culture or way things are done in my religion will count or be questioned, in addition to my other concerns.

I'm adjusting from a tourist visa not a fiance' visa; we got married 3 months after I started my visit here; this was my third visit to the US to see him. I have never been married before, and I got married in the US.

And I do realize that if there was intention to get married, we are required to go for the CR1 or K1 but there was no intention, he proposed and I accepted after a year and a half of visiting back and forth.

If only that were true. It sure sounds nice though. I changed my religion more than two years before I married and you better believe we were both questioned extensively about it at both our I-130 interview in 2003 and the visa interview abroad in 2008.

We were held by border patrol in June for over two hours at the Champlain-Lacolle land border crossing. Guess what they asked me and my husband of 9 years? More crsp about religion and things we proved about our relationship almost a decade ago.

To the OP: They may or may not ask, but be prepared just in case they do.

The I-130 interview was in 2003 but his IV interview was in 2008 and the border issue was 3 months ago. But yeah, maybe it changed since June. I doubt it. I'm not saying that they will give you trouble but they will very likely include questioning about his religious choices.

You need to be more worried about proving that your intention was not to come as a tourist, marry and adjust status. Also, if there's a significant age difference between the two of you or any other "red flags." Search the MENA area to find out what those flags are.

I can tell you that for our interview in 2003 we were separated. I, the USC, went first. The asked about everything you can imagine and wrote all o my answers down. Then, when my husband was interviewed they asked him all the same questions checking them off as they matched. You need to be prepared and confident but not rehearsed...if that makes sense. If it's such an important factor, why don't they ask about it in any of the forms? Their mission is to find out if the marriage is a fraud, I guess it doesn't make sense to me that they would drill someone for that reason. I got married in the US and my application is processing here not in Jordan, don't know if that makes a difference. I'm doing the AOS not CR-1 and my interview will be here.

Timeline

I have a long history of visits and there's not a huge age difference, it's only 4 years. Many people undergoing the AOS have been interviewed together unless there was a suspicion of fraud. I stayed here for 5 months at a time and we went to school together and took a couple of training courses. I spent a lot of time in Maine but after a year and a half and a total of 5 visits back and forth to Jordan and the US, he decided to pop the question, he had already met my family so we had their blessing. We got married 3 months after I got here, have witnesses, pictures, joint account, etc.

They don't ask on the forms because they can't blatantly discriminate their citizens (as your husband is a USC) based on religion. Same reason why on employment forms they don't ask if you are gay. That would be unconstitutional. This said, call it religion or tradition or whatever, if a muslim woman cannot marry a non-muslim man, then I am sure they will ask you/your husband about your religion and the change thereof, because it would raise a red flag if you married a non-muslim. Also, if according to your religion you need to have a certain type of ceremony, then they will want to see the pictures of it, and will ask you questions. Other than that, your religion is your business.
