Can wife travel abroad while I-751 is in process

Hello:

We just started the process and it might be very possible that my wife who is awaiting removing the conditional provision would fly to Cairo and be back in one month.

Would she need I-797 to be filed and how long does that take to process?

Oct 28, 2009 -- Wife arrived USA

Sep 6, 2011 -- Mailed I-751 Packet to lift conditions

Sep 13, 2011 -- NOA received date.

Sep 29, 2011 -- Biometric appointment.

as long as she has the NOA1 which says her green card is extended 1 year she can travel. If she does not have this she should not leave yet.

I filed my ROC on 09/03 and it arrived 09/06 and they cashed the check and i got the NOA on the week of 09/06.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

as long as she is here for her biometrics appointment...

she does not need anything if she comes back before the original expiration date.. she will need the extension if after that date

Thank you Inky. She will be in cairo when the original GC expires, so is getting NOA good enough? How does one get NOA (in mail) or by email notification.?

Thank you payxibka. Yes, her original GC will expire. Let me know if NAO is enough then or should I filed for travel documents I guess I-797 form.

You cannot file I-797. I-797 is what USCIS sends to you to notify you on the status of the case. A combination of NOA1 letter + expired GC + valid passport is enough for international travel.

She can travel with her expired GC + NOA which is the extension letter but better wait for the biometrics before she travels because she might get the appointment while she is in Egypt

I am glad i found this topic,i got my ticket going home to the Philippines next month ,my gc is expired and until now i am still waiting for my 10 yrs GC...VSC is so slow right now,but anyways i have my extension letter with me.Now i can sleep tight and i dont have to call my local uscis office.Lol..Thanks to all who responded and started this topic :thumbs: .

Yes she can. When you file you will get an extension letter good for one year. Use that in addition to her green card (even if expired)

We live at the border with Canada and Alla wnet to Canada and back several times with her expired green card and the letter. No issues at all.

Hello,

All she needs is a valid passport for six months, her expired green card, and the notice from USCIS saying that her green card has been exptended for a period of one year. My wife traveled with these documents and when she came back from Israel the officer at the USCIS didn't say anything about the documents - she was stamped into the country with no problem

It's really a pain to plan travelling while waiting for the government since they are so unpredictable about scheduling things. Way back at our first green card interview I had to bring my wife back home early from visiting her relatives because she was gone when the interview schedule letter arrived. Had to eat the cost of the unused airline ticket.

She's just been approved for the 10 year GC but it has been a month since our second interview and they haven't sent the GC yet. It's less of a problem this time because she just has to go in and get her passport stamped if she wants to travel. But still it would be nice if they could just send the GC some time soon.

May 7, 2007 -- I-129F K1 sent to NSC

Dec 26, 2007 -- K1 Visa approved.

Sep 16, 2008 -- AOS/EAD/AP sent to Chicago

Apr 01, 2009 -- Conditional green card arrives.

Feb 19, 2011 -- Mailed I-751 Packet to lift conditions

Nov 11, 2011 -- Permanent GC rev'd in mail.

Aug 16, 2012 -- Citizenship Interview. Approved.

Sep 06, 2012 -- Citizenship Oath.
