Hi

Sorry if this post is a little confusing, but at this point I just need HELP!!! Our Lawyer on behalf of my US husband filed the I-130 and it got approved early August, we thought "great" and went ahead with that procedure. It turns out that our I-129F was approved today, which surprised our lawyer as he said that he didnt think it would be approved because of the I-130. During this time another partner in the law firm paid for the I-130F and we were just waiting on the NVC to process payment. What happens next - is the I-129F moot, or because it has been approved it still goes through? Do we get a refund for the I-130? Im so confused?

did you file for a fiance visa or a spousal visa? you posted in the fiance visa section

If you are married stick with the CR-1 and disregard the I-129F scrap the k-3 because its way more expensive and a much longer process.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

We are married, we got married on May 14th this year - our lawyer filed the I-130 and the 129F for us - both have been approved. Our lawyer called us today and said that as the 129f was approved, i would hear from the NVC in 30 days with an interview date. But another partner in the law firm had already paid for the I-130? Im just really confused and the lawyers are obviously no help!

If you are married and you file an I-130, and you also file an I-129f for a k-3 visa, there is no charge to file the I-129f since you already paid for the I-130. As far as I know, they are supposed to cancel I-129f petitions if your I-130 petition gets approved first, which it sounds like yours did. Maybe they are just a bit behind on their paperwork, and they will realize this soon and cancel your I-129f petition. Anyway, I would stick with the IR1/CR1 route instead of k3.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Ask your lawyer to ignore all the correspondence regarding your I-129F and you should be fine with CR1 process.

Once the fee is paid and the status changes to PAID (in 1 or 2 days), the cover sheet with bar code can be printed and used to send the appropriate packet (AOS or IV). I guess your lawyer does that for you. Be on his back to get things moving fast else you will loose valuable time.

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.
