Hey,

I recently got married and am in the process of filing for my change of status (green card). I've been working on the I-130 and I-485 forms (and the other supporting documentation). I have a few outstanding questions if some one can help me - thank you in advance!

1. In the I-130 Form, #19 asks for my address abroad. Do I state my past Canadian address since I am a canadian citizen? Or do I just write N/A in that section since I've been in the U.S. for over 6 years now, gone through college and all?

2. In the I-485 Form:

- Part 1: For my Current USCIS Status I have wrote EAD Card Category C09. Is that correct? since my current immigration status is through my employment authorization card.

- Part 2: Application Type, I selected (h) as my basis for eligibility and wrote "Marriage with a U.S. Citizen" in the blank space next to it. Is that correct?

- Part 3: Processing Information, what is my Nonimigrant Visa Number? Consulate Where Visa Was Issued? Date Visa Issued? -- I got my visa in the mail as my EAD and I was already in the US then since it was a transfer of status I guess. Not sure how to answer this one.

- Part 3: It also asked for the date and place of filing and final disposition, when I select Yes for the question "Have you ever applied for permanent status in the U.S.? What is the date and place of filing and final disposition? -- can I check for this online somewhere? Or do I have to go digging through my parents paperwork for this? I was a minor when all of this happened. Now I'm 24 and finding it very difficult to backtrack on all these answers.

4) You didn't get AN ACTUAL K1 visa in your passport? Perhaps, the NVN is your alien number? :wacko:

5) I'm not sure whether you can find this information online or not. I do advice you to get THE information.

The OP is not a K-1 visa holder, so K1 is not their status. They do mean I-130, and NOT I-131. THey must file I-130/I-485. OP - the correct forum is one below this - a mod will probably move it. People in this forum are in a different process so the answers you get might be for what they are doing, not what you are doing.

OP - I am confused. How do you have an EAD?

1. N/A

2. How do you have an EAD card? Your status should be whatever status you have now. You say you went to school, so I assume some sort of student visa, F-1 maybe? Are you on OPT?

3. No, the correct answer is A, not H.

4. An EAD is not a visa... Confused. You probably don't have an A number unless you have OPT.

5. I am confused. Are you a LPR or a citizen? What do your parents have to do with it? If you have legal status in the US you don't need to file based on marriage.

I am no longer under their visa but I do have an Alien number and an EAD work permit. I am not a legal permanent resident yet, I did apply for it before stuck in the process somewhere. My parents are the ones that I filed my I-485 with before. My EAD serves as my visa presently.

Am I in the wrong forum?

You are an E-2 visa holder. Okay. But then you say that your parents filed a I-485 before. On what basis did they do that? And the process got stuck? I think you will need to figure out what happened with that. How do you have an EAD with no legal status? You say you aren't under their visa anymore. Are you AOS-pending with a work permit? Are you sure the I-485 isn't still processing?
