Timeline

How much do I need to make to show that I can support my fiance? PLease give me an actual number... I'm pretty sure I make more than enough but want to be sure. If I need to get a co-sponsor, I'd like to know that ASAP. Thanks! :help:

Anh map I had someone disagree with me yesterday when I commented that they needed to be at the 125% level. Is it different between consulates? Do some require 125% and others 100%? A member yesterday said that USCIS told her it was 100% for the I-134 but I tried to explain that for AOS you would have to use I-864 which requires 125% and thats what you would be judged upon at the interview.

I-134 form is used for many different purposes. The USCIS information line is staffed by CSR's that are reading from prepared guides. They are not USCIS staffers. Hence the nickname "Misinformation line."

Typically with K visa petitions the 125% amount is used as that is the standard applied at Adjustment of Status where the I-864 is employed.

No. The 125 percent of the federal poverty guideline minimum income requirement, the most recent year's tax return, and other requirements only apply when a Form I-864 is needed. Applicants using Form I-134 will need to show that their U.S. sponsor's income is 100 percent of the federal poverty guideline.

I don't disagree with what is posted on the DOS website and I know that some consulates only look that the sponsors income is 1X the poverty guideline. The I-134 is only used to determine visa eligibility isn't it? Doesn't it expire when the K-1 expires on entry? The I-864 used for AOS is the binding document and it requires 1.25X. Is it possible that a petitioner who makes 1.1X poverty gets the visa issued and then can't get AOS?

I agree with everything you said. And yes, I think people get a visa then scramble for help when they get to AOS. I've seen it on here a number of times. Consulates can vary in what they will accept for a visa.

I agree with everything you said. And yes, I think people get a visa then scramble for help when they get to AOS. I've seen it on here a number of times. Consulates can vary in what they will accept for a visa.

It seems like its a paperwork issue but I'm sure there is some history behind it. My opinion (for what it's worth) is that every K-1 petitioner should use 125% or get a co-sponsor up front. Might save a lot of heartache down the road.
