how to get check refunded :(

hello,

We applied for the adjustment of status a few weeks ago to the chicago lockbox. We have since decided to wait a bit longer to apply because we don't want to spend the 1070 dollars right away. I thought we had to apply immediately afyer the wedding, but it seems thats not the case. So we went to the bank to cancel the cheque and they put a stop payment on it but it wasnt enough time and the money came out. Does anyone think I might have a chance of getting it refunded if I call and explain? Or is there another route I could go down? And would anyone please have the number for the chicago address?

October 8th- Sent off K-1 visa package

October 21st- Received email saying we have been assigned to CSC

October 28th- Waiting on NOA1

October 29th- NOA1 received!!!

March 16th 2011- Received email saying petition for fiance has been approved and that NOA2 is in the mail!

April 12th 2011- Waiting on lettter with interview date from Dublin Embassy. Medical scheduled for 26th April

Timeline

Chicago just routes the submissions to the service centers.

There are no refunds that I am aware of.

Moving to AOS from family based visa.

OP, you should be glad you've started AOS process - you'll get an EAD and green card so you can start working. Why would you wait?

Your fee will not be refunded. USCIS will only make a refund if it makes an error or a fee was improperly collected.

When an applicant or petitioner pays a filing fee on an application, he or she is seeking a decision from USCIS regarding the applicant or beneficiary’s eligibility for the benefit(s) being sought. In general, USCIS does not refund a fee or application regardless of the decision on the application. There are only a few exceptions to this rule, such as when USCIS made an error which resulted in the application being filed inappropriately or when an incorrect fee was collected. For example, if USCIS advises an applicant to file a waiver application for a ground of inadmissibility which is inapplicable to that applicant, the fee should be refunded.

If an applicant or petitioner believes that he or she is entitled to a refund of fee, the applicant or petitioner should call the customer service line or submit a written request for a refund to the office having jurisdiction over their application or petition. USCIS will review the request for a refund and either approve or deny the request based on the information at hand. If the adjudicator finds USCIS made an error, then the officer will complete Form G-266, Request for Refund of Fee. The form is av ailable on the USCIS Intranet. Send the completed form to the Burlington Finance Center (BFC), P.O. Box 5000, Williston, VT 05495-5000 or fax it to (802) 288-1230. Retain a copy for office records, following local procedures. Send only the completed form to BFC, retaining any back-up documents, applications, etc. The BFC will notify you of the disposition of the request. Only a single refund may be requested per form.

Don't look at it as a bad thing, this is a better decision and you will be happy to have your GC! You can work, travel.. so many more benefits!

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)
