Hello Visajourney affiliate. First of all I wish to thank all of you for posting your cases. It really helped us while we were filling forms I130, I485 & I765.

The situation is that my Husband, the US Citizen and Petitioner, lost his job 2 weeks ago.:(, I still haven't received my Employment Authorization Card, which I'm desperately to get, so I could help him with the bills. Our concern now, is that since his my sponsor, we don't know if by the time we get our Interview date and he doesn't have a job, Will that be a problem since he is my affidavit? Do they ask again for a letter from the employers? Sorry for my English, my native language is Spanish.

Thanks for your help in advanced.

I don't have the answer to your question but I just wanted to let you know that your English is almost perfect. Hang in there. Everything has a way of working itself out. If you are no longer able to use him as a sponsor, maybe you can get an additional sponsor.

I'm very sorry to hear about your husband's job. To answer your question the I-864 needs to be current when your file is adjudicated, which means you'll probably need a co-sponsor now (unless he gets a new job fast, which is possible!). The good news is that your EAD will not be affected and should come like normal. You have from now until the interview to secure a joint-sponsor. Good luck!

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

Thanks for your advise, really appreciated. We'll start looking for a new sponsor.
