Wouldn't allow me to get a Driver's License :(

Well I already have my SSN, they allowed me to get that a few weeks after getting married. I don't really want to give up my CA one though, so I will just wait.

June 7, 2010 - Will asked me to marry him, and I said YES!!

October 15, 2010 - First "touch"
October 18, 2010 - Second "touch"

March 18, 2011 - NVC forwarded our case to the Montreal Consulate....NOT where we wanted it to go!
March 25, 2011 - Email from Montreal saying that our case would be forwarded to Vancouver - only took one night for a reply from them smile.png

April 6, 2011 - Received Packet 3 via email - now just waiting on my police certificate.

"Birth date verification and legal presence requirements

The issue of identification reliability, integrity, and confidentiality is of prime concern to all citizens. Eligibility for government services, issuance of various licenses, assessment of taxes, the right to vote, etc., are all determined through evaluations based on identification documents. It is critical that identification documents be authenticated and accurate in identifying each individual. The California driver license and ID card have been declared as primary identification documents in this state by the California legislature.

State law requires every applicant for an original California identification (ID) card and driver license to show verification of birth date and proof of legal presence within the United States to help safeguard the accuracy and integrity of departmental documents.

If your current name no longer matches the name on your birth date/legal presence document, see "True Full Name" and "How to Change Your Name" for more information.

Only the original or a certified copy of one of the following documents is acceptable:

US Birth Certificate (certified copy from state or local vital statistics office)

US Certificate of Birth Abroad or Report of Birth Abroad

Federal Proof of Indian Blood Degree

USCIS American Indian Card

Birth Certificate or passport issued from a US Territory

US Passport or US Passport Card

US Military Identification Cards (Active or reserve duty, dependent of a military member, retired member, discharged from service, medical/religious personnel)

Common Access Card (only if designated as Active military or Active Reserve or Active Selected Reserve)

Certificate of Naturalization or Citizenship

Northern Mariana Card

USCIS US Citizen ID Card

Permanent Resident Card

Temporary Resident Identification Card

Canadian Passport/Birth Certificate

Non-resident Alien Canadian Border Crossing Card

Valid foreign passport with a valid Record of Arrival/Departure (form I-94)

On the DMV website it lists that a Canadian passport is acceptable....as well as my NOA. So could I just print that off their website and show them?

Actually, my wife did get permanent DL in California this year almost immediately. If it helps, here is a timeline:

1) Arrived April 29th.

2) Got married May 4th and changed name

3) Got SS# on May 17th

4) Applied for AOS NOA1 May 25th

4) Written test - June 6th

5) Behind the wheel test - June 17th

6) Permanent DL in hand with 2016 expiration - June 30th.

7) Got green card - July 28th

However, she already had Russian DL in hand for many years.

Thank you for your recent e-mail regarding obtaining an Ohio drivers license. I also want to thank you for using the e-mail link on the BMV website to post your questions and concerns. It provides valuable feedback and helps the BMV to better our operations.

It is possible to test and obtain an Ohio drivers license without the actual green card. Your husband would be required to provide a valid foreign passport, I-94, the USCIS document I-797c with case type I-485 (application for permanent resident status) and social security card if ever assigned a social security number.

I hope I have answered your questions. Please let me know if I can be of further assistance.

Would they take it away after his I-94 expires? I couldn't say. Would the person at the desk agree? I anticipate a struggle, as in all things.

Would I have to give up my CAD drivers license? If that were an option, wouldn't they have told me that when I showed them my CAD license?

I have my Canadian drivers license still, they have done nothing to it its in my wallet. Its still valid until 2014.

In CA they have a DMV service where they keep your place in line. Once your turn they call you back.

Haha yeah thanks, I chose that option. Their just dimwits and don't know how to transfer me to their supervisor without hanging up. I'm waiting for them to call back again :P

Ok, well final answer I could get out of them is that I either need an EAD or Notice of Action (I-797 Approved Petition). However, I'm assuming that that isn't the NOA that I am currently waiting for in the mail, which just states that they are accepting my application, but one they send that says my application is approved. At least the EAD will only take a couple months :)
