I am sorry to hear it was denied. It was denied because of misrepresentation. You must disclose everything they ask on the forms. The issue is not whether the wives were american, foreign, or from outer space, but rather that you did not tell the truth about it, and did not provide them with the necessary documentation. They cannot issue the visa if there is missing documentation (ie second divorce cert).

Hopefully you will just need to correct the form and submit the divorce certificate from second wife. I agree about contacting a lawyer, to make things go correctly from now on and to make sure forms are filled in fully. The embassy will provide your fiance with a list of options available (depending on whether it is an RFE or a full denial).

Why you think this should have gone thru?

When any item not disclosed and found out by USCIS they would not let that case just slide by.

They would do more digging as why all the details were not completely disclosed, why is applicant not completely disclosing every details.

My fiancee and i didnt list my kids on the I-129f ( completely by accident we misread the question) but i did list them on my forms for packet 3 and i was questioned at the interview how many kids do i have and if they will be following. sorry for being off topic

An AP (known as 221g i think) just means they need more time to review the case and she/you may get a letter requesting further paper work

Well, your I-129f petition will probably be returned to USCIS to have the approval revoked as they have new information which indicates you were not truthful on the petition (I understand that wasn't your intent but it was the effect of you not reading the instructions and attaching an additional sheet with the required information).

Since the US Citizen is the one who provided false information the good news is that the beneficiary shouldn't be charged with Material Misrepresentation which would trigger a lifetime entry ban for her.

This situation justifies at least a consult with a competent immigration lawyer to see who the revoked I-129f should impact a future filing by the same petitioner.

On the original I-129F we only listed the kids who would be coming here and said "Other children are adults and are not emigrating" and left it at that. For packet 3 we needed to get all the data and for the interview we got he birth certs of all the kids, staying or not. Way too much paperwork but yes they need to know the divorces are legal. You'd think to be married a 2nd time the 1st divorce must have been legal, but they want paperwork anyway.

If she is not willing to talk to you she may be getting cold feet or have other concerns. She did know about your former wives, yes? That could be a shock if she did not.

Call NVC/State Dept for an update on our end!

I am not saying ppl don’t make mistake filing out the forms.

They are given a chance to correct it, I have even heard of cases where ppl have wrong information on i-130 and they made correction during the visa interview.

In case of OP he mentioned 1st divorce skipped the 2nd one and mentioned the 3rd one…..so that would make most CO think he is trying to hide something, even though he might not be trying to hide anything.

CO can reject a visa based on this saying ahhh this is mis-represented there could be many more things that are not completely disclosed by the petitioner.

I called NVC and found that it a temporary hold and I need to mail a copy of the divorce papers to the embassy to complete the process.

I personally don't think this is a denial at all. My now husband had been married 3 times before and divorced and when I got to interview they were missing the 2nd divorce papers. They asked me how many times he had been divorce and the names of the women , I told them and he said ok we are missing number 2 even though Wayland had sent it in all 3 copies of divorce papers. All I had to do was get a notarized copy of 2nd divorce and send it to my consulate. It did delay us I will admit as he expressed posted it USA to AUS taking 5 days lol I knew it had arrived but the lovely consulate sat on it in the mail room for 5 days . Hence 2 weeks later I finally got my visa and made it home 1 week before my wedding .

SO I am very sure that all they need is a notarized copy of divorce decree number 2. Or as someone mentioned she did not know about number 2 and now has doubts. Just saying is all.

Just to note whenever there is not enough room on the application add information on added paper referring to question at hand. (common sense really).
