Abadoning your K-1 visa and just getting married instead

Just wondering about a few things. If we get married in Morocco reglious wedding only. Can we proceed with the Visa Fiancee? If we would get married in Morocco and they consider that legal, If you want to proceed with him coming here do I have to reapply? What forms? Do you really have to start over with the wait times? Thanks for any help you can provide.

This is a bit of a sticky situation.

I suppose though to answer your question, that yes you can do a religious ceremony and if it is not registered in Morocco then you can still file a K-1 however you would be petitioning for your fiance when he is really your husband right?

As far as the legality - if Morocco consider it a legally binding ceremony, the US will too. I'm pretty sure of that.

Once you are married, you can't bring your other half here as a fiance - check out the K3 forum and guides, and also the DCF forum. You do have to start all over again with processing times and a whole new set of fees.

I am not sure about what you propose but if you get married you have to start the process again and apply for a K-3 Visa.

Honestly I don't think you should abandon the K-1. That would be silly as it would take twice the time to do a K-3 most likely.

The only thing I'm wondering is whether DCF is open to them, and whether it would be quicker. I believe I read a thread about someone in Morocco who did this just the other day, but I will try and find it for reference.

I believe you have to be there for 6 months. I could be wrong but I thought I read that somewhere.

Well, that's the thread I was thinking of, but the country was Malaysia, not Morocco.

This is from the Casablanca US Consulate General website:

Sometimes, a U.S. citizen living abroad can file an immigrant visa petition at an U.S. embassy or consulate (post). The US Consulate-General in Casablanca petitions ONLY from US Citizens RESIDING in Morocco. A petitioning US Citizen must provide a valid Moroccan residency permit issued by the Moroccan authorities. A valid Moroccan Resident Card is the ONLY document considered proof of residency in Morocco.

Quite sticky indeed.

If you ONLY have a religious ceremony and do not get all the legal paperwork from the government of Morocco you will NOT be legally married per immigration law. Many have done this and had so many problems with this "type" of marriage.

Why you may ask.

Well you will consider yourselves to be "married" but in the eyes of the law you are not but in the eyes of God you are. See how confusing it gets?

You will get him here faster by sticking with your filled K 1 since this is what you have already done.

If getting him here fast is not a consideration and you don't mind wasting the money you paid for the K 1 then just make sure if you do decide to get married in Morocco you make it legal by the governmant. This will avoid so many problems in the future.

BTW...DCF is only available to those who can prove they have residency in Morocco for at least 6 months. It can be difficult to secure that proof. DCF is not really an option there for this reason.
