I too only spent $50 to have my 3025 transcribed over to 693 and mine was incomplete too and I just needed a flu shot.

Hi guys!

I have some questions about the procedures involved in the AOS application. I just sent my package two weeks ago and I didn't hear from USCIS yet. My greatest fear is that my K1 visa expires on Oct. 3rd and I don't know what I'm supposed to do if they don't contact me on time. Is it normal to take that long to have your package precessed? If they don't give any sign until my final date, what should I do? We know the package was delivered because we checked in the mail website but I know I cannot be considered IN the process until they send me a formal notification. WE called the USCIS and they said it was too early to give us any information :(

Any info about it or advice will be truly appreciated.

Your K-1 visa "expired" the moment you used it to enter the US. Its a one entry visa and is no longer valid. Your issue is maintaining your status to become a legal permanent resident (green card holder).

Thanks! We have called them already but they said it's too early for them to give us any information. :unsure: We definitely have to wait. My big concern is since I don't have any notification which shows that I have applied to the AOS I could find myself in trouble if someone asked for my documents. Of course I have my SSC and my ML but it doesn't mean I have send my package on time.

You are not out of status until the I-94 expires. Once that happens, with a filed AOS you are in a limbo state until the GC is issued. As others have mentioned the K-1 is a one entry visa and is no longer valid once it is used to enter the US. Then you have until the I-94 expires (90 days) to get married. Once you do that you then have to file for AOS, but there is no time limit on filing (there is an issue if you wait over two years, but that is another thread). From I-94 expiry to arrival of GC you have no documentaion that states you are in the US legally and can have issues if confronted by CBP person, plus you cannot work nor travel outside the US until the EAD/AP or GC is approved.

It took us about three weeks to receive the actual letter from the USCIS that the AOS was accepted. It sounds like you have done everything correctly and have nothing to worry about. You are back to the waiting game again, but at least when the AOS is approved you are done with the USCIS for 640 days.

This is a little bit of a rude reaction seeing that the person who corrected you was perfectly correct. Your visa expiry and I-94 are two different dates. I landed in the US with about 5 months left on my visa "expiry" and I would hope someone would correct me if I thought my VISA expiry was the date that matters... which it isn't.

You claim to know all this and yet your post implies otherwise and COULD confuse other members who don't know the difference between visa expiry and I-94 expiry (and especially seeing the difference is a large one).

I am so sorry Vanessa if my words sounded rude to you. Sincerely, it wasn't my intention quite the contrary. I thought I had made it clear I was " just kidding" but due to your words I realized I hadn't and I am really sorry for that. VJ has been a great tool during my entire visa process and I am truly thankful for all those who have been willing to help. However, I believe your reaction is a bit more than rude. First, if you had the chance to read the entire post and the comments which followed it, people don't seem to be "confused" by my question. All the answers (including YOURS) are clear and helped me a lot. I totally agree there's a huge difference between visa expiration and I 94 expiration and I have to thank Mat for pointing it out, BUT it seemed to me that EVERYBODY (according to the answers) understood my point. Honestly, none of us are here to "claim to know all this". If i knew "all this" why would I be here asking for help? What's the point?

Once again I am sorry if you felt offended by my words but you should also reflect about yours. Being judgmental might lead us to unnecessary discomforts.

No problem as long as you got married within 90 days and you already filed the aos. You are good to go. M wife's I-94 also expires after we filed for aos.

The laughing one implied you though it was hysterical they didn't understand you and were laughing AT them, and the bonk one (which I hate) implies you think they're a complete moron who needs to be hit over the head with a mallet to knock some sense into them. I really really hate the bonking one which is why I removed it when I quoted you.

The laughing one meant that I was laughing AT my OWN joke (once again, just to remind you I said "just kidding" do you remember that?) The bonking one meant I WAS THE MORON since I had expressed myself wrongly.

Your words, AGAIN, sounds pretty much judgmental and emotive. What is interesting is that you seem to be much more sensitive to them than the person who they were directed to.
