AOS - docs. sent. Visa expiring soon. No wordd from USCIS yet

Hi guys!

I have some questions about the procedures involved in the AOS application. I just sent my package two weeks ago and I didn't hear from USCIS yet. My greatest fear is that my K1 visa expires on Oct. 3rd and I don't know what I'm supposed to do if they don't contact me on time. Is it normal to take that long to have your package precessed? If they don't give any sign until my final date, what should I do? We know the package was delivered because we checked in the mail website but I know I cannot be considered IN the process until they send me a formal notification. WE called the USCIS and they said it was too early to give us any information :(

Any info about it or advice will be truly appreciated.

This isn't a problem at all, don't worry.

The USCIS website never updates on a regular basis, I had a letter for the biometrics before the website was even acknowledging my case.

So long as you filed your A.O.S. paperwork it does not matter.

So long as you filed your A.O.S. paperwork it does not matter.

What worries me is that the only proof I have that the paperwork was sent within 90 days is the mail receipt. Even the fee was not taken from our bank account yet. I sent it to the U.S. Postal Service address instead of the Express mail one, does it make any difference?

You will be fine... all you had to do was get married within the 90 days, which, you did.

01/23/23... interview scheduled for 02/28

Still should be good. There are many people on here that have stated that it took weeks for their checks to be cashed.

For us it was to save up the $1070.00 to file. This isn't a big deal and you will be fine. You just can't work until you get your EAD and can't travel until you get your AP. Some couples have waited as long as 2 years.. :blink:

As one member pointed out, the main thing was to comply with the marriage within 90 days. Some people, as we have, wait a little longer to file AOS for various reasons. For us it was to save up the $1070.00 to file. This isn't a big deal and you will be fine. You just can't work until you get your EAD and can't travel until you get your AP. You will be fine. The K1 expired the moment you entered the country. You got married and complied with the terms of your visa, so you're good. Even better, you have already filed for AOS, so you should be hearing from them soon. Keep an eye on your bank account to see when the check is cashed. Soon after you will get your NOA1 in the mail. You can sign up on the uscis website as well after that to check on your case status. There is no problem with sending it to the regular address vs. the express address. Hopefully you will be getting the letter soon. I know this process is so stressful, but you will be done soon and can relax for awhile. Congratulations on your marriage! :)

Because unless you had EVERY shot on the list then you WERE incomplete (and not all shots apply to everyone based on their age and health). That's the way it's supposed to be done. If you had all shots you don't need a vaccination transcription and could have just sent a copy of the DS-3025.

I had all the shots and exams which were required from me by the consulate before the interview . Even though, the doctor checked the "incomplete" box on my DS -3025 form. According to the instructions to the AOS, if it happens you have to report your vaccination board to a Civil Surgeon to complete the I 693 form and I did. It was really frustrating when the doctor looked at me and said everything was ok!( I knew that!) It was just a waste of time and money :angry: .

When I had my medical I was told by the doctor the list of vaccinations were all done, BUT she said that the incomplete would be ticked as the Tetanus would not be up to date, even though I had it just a month before. This shot is active for I think 10 years but it would not be fully 10 years to the next one if that makes sense.

No. If you read the I-693 instruction they tell you a different story. The DS-3025 is sufficient if you had every shot. If you required further shots then you get a vaccination transcription.. or you can get the transcription anyway like I did just in case. You can even get the whole new medical if you want, but it's not required. If your shots were complete (regardless of the form saying complete or not) then you would have been fine with the DS-3025.

You had every shot required for immigration, but you were NOT "completely" immunised. You didn't have every single shot on the DS-3025, if you did THEN you would have had "complete" ticked. It's in the panel physician technical instructions, it wasn't wrong.

Exactly why I got one as well! Some people can't afford it though (cheapest in my area was $50) which is why I'm telling you it's not required. so far i've done the entire process without an RFE and hoping to keep it that way come ROC as well!
