There is no hard rule, only that you can't stay longer than 6 months at a time and of course you can't be longer than 6 months in the U.S. in any given calendar year as that would make you a U.S. resident for income tax purposes.

When i went to visit my fiance (with no visa) just entered as a visitor. We did talk to a immigration lawyer about options we had and all that. and she did inform us that since i was just a visitor (no visa) i was only allowed to be there 90 days. So i left in 86 days and came home to start the K1 FIance Visa Process.

2010 MAY 17 - MET IN PERSON

2010 OCTOBER 9 - 2ND VISIT TO U.S

2010 NOVEMBER 30 - 3RD VISIT, HE COMES TO CANADA TO MEET MY PARENTS

2011 APRIL 17 - 4TH VISIT SPENT 3 MONTHS IN U.S WITH HIM!!! :)

2011 JULY 11 - ENGAGED

2011 AUGUST 5 - SENT I-129F TO DALLAS

2011 AUGUST 11 - NOA1 TEXT/EMAIL

2011 AUGUST 15 - NOA1 HARDCOPY

I'm not sure what kind of immigration lawyer you talked to but there are special rules for Canadians with regards to Visas and length of stay. You could have stayed for 6 months and applied for an extension as long as you weren't working or other activities that require a Visa.

Add up all your visits in a 12 month period. Count days you arrive and nights you stay here. You are allowed 6 months less a day here in the USA in a 12 month period. Most of us Canadians didn't get stamps in our passport when we travelled back and forth, the officer usually doesn't bother for Canada. There are lots of Canadians who are snowbirds and travel back and forth every year...but always count the days.

Main problem with being over 6 months is you will be taxed in both countries....not good.

I just emailed the embassy to verify, if they actually reply I will post the response to help clear it up for anyone else who may wish to know.
