Hi,

I'm an F1 student filing for AOS

My husband and I need a co-sponsor. His business partner (also a close friend of ours) agree to help us out. However, he's married.

My question is: Does his (co-sponsor) wife need to fill out any kind of form or sign anything at all? Or she's not involved in this?

I have a few more specific questions on the forms and hope yall can help me answer them.

I-130: Question 7: Does “other names used” include nickname?

Both my husband’s name and my name are hard to pronounce. Thus, we do have nicknames that we use at work and school. These nicknames are not on any legal paper; however, they are used by our families, friends and coworkers. So should we include them in “other names used”?

I-130: Question 17: “list husband/wife and all children of your relative”

Do I list my husband in here? He’s the one filling I-130 for me.

Or do I list “None”

G-325A for my husband (USC): it says “this form is submitted in connection with an application for:”

Do I put “Other: I-130” or “Status as permanent Resident”

How about on the G-325A for myself?

Do I put “Other: I-130” or “Status as permanent Resident”

Also, it says “List applicant’s last address outside the US of more than 1 year.”

Do I list my address in my home country where I lived up until Sep 2006? And I also came back home from Jan 2008 – Mar 2008.

“Last five year employment”

Do I list my student status and the school that I attend?

I-485: Part 3B: it asks for my husband info. Should I answer NO for “Applying with you” since I-485 is for myself only, he’s a USC.

In Apr 2007, I filled for I-539 to change my J1 (exchange student) visa to F1 but got a denied letter in Dec 2007. I left the country in Jan 2008 (within 30 days from the day I got the denial letter). Is this considered as deportation/removal?

I-765 Application for employment authorization: Question 15: Do I put F1 or Pending AOS?

Question 16: what should I put into “eligibility under 8 CFR 274a. 12 ( ) ( ) ( ) “

Most of the answers to your questions can be found in the instructions for the forms. To be successful, you need to answer the questions literally. For instance, if they ask for your last address abroad for over a year, you must put your last address abroad for over a year. There is no guesswork - it is just answering the question.

So for your specific questions:

Co-sponsor's wife only needs I-864A if you need to use her income.

I would put nicknames.

Yes, you list the husband or wife of you, which is your husband. Keep in mind the USC should be filling out this form, not you as the immigrant.

Status as perm resident for both, though some put other for the USC and it works okay.

Answered above. If it asks for your last address abroad of more than a year, put your last address abroad of more than a year, which looks like 2006.

School is not employment, though you can put it there to explain the gap in work.

Yes. A denied visa is not a deportation, though you will need to disclose the denied visa.

I'm also a bit confused about when I can apply for SSN. The lawyer/friend that I have told me that as soon as I receive letter notice that the package is received and is processed, I can apply for SSN. I thought that I need to have AED to be able to get SSN?
