Hello everyone,

I have a question and really need an answer from anyone who may have succeeded in receiving visa expedite due to a medical condition. Ok, alittle background.

I have filed the I-130 for my husband who is the beneficiary for a cr-1. We have recieved the NOA1 from UScIS a few weeks ago. Last week, I was admitted to the hospital with a brain bleed and learned I have a tumor located in my brainstem. Surgery may be needed if possible or another brain bleed may turn to an anuerism if not treated. I am unable to drive, lost my job, have small children, with medical appts to attend. I am extremely upset and need my husband home with me.

I am trying to see if I am able to expedite our process due to my medical condition. I am not sure what information I may need from my doctors, letters, scans, not really sure what they may be looking for. I have a GP doc, neurologist, and a neurosurgeon, should I try to get letters from all physicians and perhaps contact my state senator before sending my letter to uscis...

This is a serious situation that has me already seiously depressed, which may leave me handicapped or possibly death. I am desperate for any help or direction to go.

You need to collect letters and information on the most serious parts of the issue.

The more serious it is the better chance you have of getting an expedite. The more proof/information you have the better chance you have for expedite. Get a letter from each doctor and any other proof that you can such as positive test results etc. You should also write a detailed letter explaining you have young children lost your job and etc and need him here to help you with these things. The more detail the better.

Call USCIS once you have these and request expedite, see if they will allow you to fax over the information to them as you have it all prepared for them right that second, if not you will have to wait for a letter from them requesting the information and mail it back to them.

sorry for sickness,yes you qualify for expedite.get the your doctor's report,then made a copy and write some addition not with you case no. to uscis.

again when the case gets to NVC then e mail them and attach the report.DO NOT post mail the report to NVC,it will delay your process.they will expedite right away.i wish the best of this journey.

Why on earth would she wait MONTHS till the petition got to NVC. She only got the NOA a couple weeks ago. She should be calling USCIS the second she has all the papers and requesting the expedite and faxing the information to them.

I would suggest calling the number listed and ask them what sort of proof of your medical condition would be required. While you are asking about proof, also ask them which form would be appropriate to ask for an expedite of your 129F.

Expedite Criteria per USCIS:

All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Director. The burden is on the applicant or petitioner to demonstrate that one or more of the expedite criteria have been met. The criteria are as follows:

Severe financial loss to company or individual

Extreme emergent situation

Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States

Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)

USCIS error

Compelling interest of USCIS

Note: Discretionary expedite requests for petitions and applications that have Premium Processing Service available will not be considered for expedite processing. The only exception is when the petitioner is a not-for-profit organization designated by the Internal Revenue Service. For information regarding premium processing, please refer to the premium processing webpage.

OP does not have an I-129F they filed for a spousal visa with I-130 and the OP is married. There is no " form " for expedite.

OP does not have an I-129F they filed for a spousal visa with I-130 and the OP is married. There is no " form " for expedite.

Not to slow you down but insurance wise is your condition going to be covered in the US by your husbands insurance ? It would be a shame to rush to the US and then end up being bankrupt because of lack of medical insurance or being declared a pre exisiting condition. Also with a brain bleed will they even clear you to fly ?

This will not be over quickly. You will not enjoy this.

OP is a USC the husband is the beneficiary. It is the USC with the medical condition.

The OP posted that SHE applied for her husbands I-130 who is the beneficiary of a CR-1. So she's the USC.. she's the one with the medical condition and wants her husband here in the US with her.

If you've lost your job, keep in mind that you'll need a co-sponsor at the NVC stage if you don't have enough in assets. Good news is that London is pretty liberal about that sort of thing. I'm so sorry and hope you get the care you need with your husband at your side (F)

Sorry for the life threatening situation but i must tell you that you are good to go...if you can check my profile my case was expedited based on my wife health reason...just 15 days after the original submission and your case is really extreme to compare with hers...just call USCIS...inform them about your situation...letter from your doc detailing the seriousness of the case is enough..you can fax it but they will give you instruction on how to do it...just follow their instruction...you will be ok. Wish ya the best.

Thank you all so much with your input and well wishes. Going into this spouse visa is hard enough, then to be told of my health and knowing my husband is not by my side has made this process even more challenging. You all have gave me some comfort and some direction to take. (L)

I have tried to gather as much info about my medical expedite and trying to coordinate with my doctors before I send my request in. I have my General Practioner preparing a letter about my condition and will be seeing my neurosurgeon within 5 days, yet my neurologist is booked two months from now. Was wondering would the neurosurgeon and my family doctors be enough evidence, minus a letter from my neurologist due to the fact I am unable to be seen by her for 2 more months. AND Do I need to get my scans, MRI, reports with all the medical jargon too...I am not sure what things they may ask for...anyone have any idea
