What a rough situation, you really did everything in your power to make this work, i don't think you could have done anymore. It is him, he just may be immature or crazy! Don't give up hope and you are right about one thing, MONEY COMES AND GOES!! For the woman I have in my life now I would have sold my house as well , TWICE!! =)

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I am sorry you have had such a difficult journey. I want you and all other readers out there to know not all of us Americans are like that. Going against what many people say I gave my fiance money in the Philippines. I asked her to quit her 11 hour a day job and I put 2 years income in a bank account in her name I had no access to. I explained to her I could deposit but not withdraw and that money was for her to live on in case I turned out to be a bad man. It's still there and will be there in case she can not adapt to life in the US so we are all not like the man you fell in love with and gave your life to.

On behalf of us good guys I apologize and while as my fiance says "it is very hard to reach your country" I hope you get what you desire and are happy.

The people I have read about here, the truly good people and the crazy ones, all found this place and I am grateful for it and the information good and bad, it brings to all of us

I guess it's not about nationalities, it was probably back luck and all the excitement that got me blind and not to see what I see now. I've also read many of the stories here and the 'signs' are always there but sometimes we just don't want to see them. I see things in a different way now but I still hope one day my heart will heal and will be able to love again... maybe i find the right man then.

Thank you all for your replies. I did not know i could file for the divorce in my country, I'm not from the Philippines, I'm from South America. I guess I'll have to find out how to file for divorce but that's easier than depending on him.

1- With all the experience, the least I want is to go to the States; just thinking about it brings all the memories and the sadness back. I think one day I'll go visit and finally have peace.. knowing that the nightmare is over.

2- Last year he was starting a new business and things were hard but I know this was a good year for his business. I think there are really no assets to split unless he has hidden them from me, anyway I'm not interested in anything but divorce. Sometimes I think he just enjoys to control things, that he is a womanizer and as long as I'm away, it doesnt bother him but you may be right that he may just not want to spend money.

Ok, file for the divorce in your country. If you ever apply for a B2 visa then the issue of the K1 might be raised at the interview. Be prepared to explain your situation, and have a copy of your divorce decree to prove you're no longer married. Did you turn in your I-94 when you left the US?

As I mentioned, it's a common misconception in the US that a husband has to give his ex-wife half of everything he owns during a divorce. It's not true in any state. In most states you would split any assets acquired during the marriage, but anything either of you owned before the marriage would remain your own separate property. Unless he came into a large sum of money after you were married then he'd have nothing to fear from a property settlement - he won't lose anything. I don't know if that's what's holding him back from divorce. I only mentioned it as a possibility because, as I said, many people have this misconception about divorce in the US.

You were out of status, but you only had two days of overstay. Not a problem. The only adverse effect from an overstay of less than 180 days is you wouldn't be eligible for any of the streamlined visitor programs like the Visa Waiver Program. You'd need a visa to visit the US. That really wouldn't affect you since there are no South American countries that currently participate in the VWP.

Turning in your I-94 ensures that your exit from the US was properly recorded.
