To be honest, I am not sure how long after the marriage you have to file. We filed around a month later but that was because of not having all the documents to hand right away. I would reccomend as soon as you can but I do know of at least one person who waited more than half a year to file.

If you've got your papers ready to file then do it as soon as you can. No reason to wait. We were aiming to file within 90 days of my entering the country on a K1. Not sure what the exact rule is. and we would have filed even earlier except we had a little difficulty getting our marriage certificate. So anyway file as soon as you can.

Visa received Sept 30, 2004

Arrive in US Dec 1, 2004

Married on Dec 30, 2004

Sent AOS, EAD and AP on March 1, 2005

Received NOA for AP, EAD and AOS on March 23, 2005

AP approved on April 25, 2005

Biometrics appointment May 11, 2005

Received EAD card May 19, 2005

September 20, 2005 case transferred to CSC

October 5, 2005 CSC starts processing case

November 21, 2005 AOS approved - welcome to america letter received

December 3, 2005 received green card!

I-751 application

October 13, 2007 mailed application (with delivery confirmation)

October 15, 2007 application received at VSC

October 22, 2007 check cashed

October 26, 2007 Received NOA1

November 5, 2007 Biometrics appointment letter received

I would also suggest sending in paperwork as soon as you have everything. I personally know of someone who waited, thinking that since she wasn't going to be working there was no hurry. She became out of status, and that created a whole new set of problems, which I'm sure you'd prefer to avoid. I'm sure there is someone who knows the exact answer, but I believe since there is a 90-day limit for the marriage, they want to see that you got married, hence send in the paperwork!

Hi rncarterjm,

It does not matter the important thing is that you guys get married 90 day from arriving with a K-1 Visa. Two VJ members have posted here on VJ that they applied for AOS after 2 years after arriving to the U.S. But they got married before the 90 days and they were approved according to them. I would not take that risk but good luck.

AOS filed more than 1 year after the K1 expired.

No problems.

(Under current status I put 'K1 Out of Status').

You won't be able to leave the country and come back in unless you complete your AOS first though (once you become out of status).

Time after the expiry of the I-94 and filing for AOS is out of status time, regardless of whether or not you got married within the 90 days. This presents a problem if you accrue 180 days out of status and wish to travel using the AP - ie. they won't let you back in, AP or not, and you'll trigger a three-year bar on reentry. If you don't intend to travel, I'm sure it's less of a big deal.

As long as you got married within the 90 days of arrval to USA then File when you can , while your AOS processes start establishing joint accounts, and gathnering evidence of the legitimacy of the marriage.

I don't reccomend you do as my wife & I did, but we didn't file until 19 months after we were married.

When we go to our interview Next week :dance:

we will be close to our 2 year marriage mark and will hopefully be granted LPR instead of conditional GC.

Either way I would start the process as soon as you can who knows what laws will change come Nov 2 elections.
